CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2016 — 59 <br />BY: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE MAYOR TO ENTER INTO A <br />MEMORANDUM OF UNDERSTANDING ("MOU") AGREEMENT <br />WITH THE CUYAHOGA COUNTY BOARD OF HEALTH TO <br />PROVIDE THE CITY OF NORTH OLMSTED WITH SAMPLING <br />AND MONITORING SERVICES IN ACCORDANCE WITH THE <br />REQUIREMENTS OF THE NATIONAL POLLUTANT DISCHARGE <br />ELIMINATION SYSTEMS ("NPDES") PHASE H STORMWTER <br />REQUIREMENTS, AND DECLARING AN EMERGENCY <br />WHEREAS, the Board of Health proposes to enter an Agreement with the City of <br />North Olmsted, the terms and conditions of which are outlined in the attached MOU, to <br />provide for and fulfill NPDES Phase II Stormwater Program sampling and monitoring <br />services on behalf of the City of North Olmsted; and <br />WHEREAS, the MOU provides that Board of Health will conduct, at a cost of <br />$5,071.00, monitoring, sampling, tracking, education and reporting services on behalf of <br />the City of North Olmsted; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to enter into <br />said MOU with the Cuyahoga County Board of Health to provide for stormwater <br />monitoring pursuant to the Ohio EPA Phase II Stormwater Program requirements and to <br />thereby promote the health, safety and welfare of the City of North Olmsted. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: The Mayor be and he is hereby authorized to enter into a <br />Memorandum of Understanding Agreement on behalf of the City of North Olmsted, a <br />copy of which is attached hereto, with the Cuyahoga County Board of Health, to provide <br />the City with monitoring services in accordance with the requirements of the National <br />Pollutant Discharge Elimination Systems Phase II Stormwater requirements. <br />SECTION 2: Provided the cost of services does not exceed $10,000.00, the <br />Mayor is further authorized to enter into additional subsequent, renewal contracts / <br />MOU's to provide for the same or similar services by the Board of Health as may be <br />required in the future. <br />
