CITY OF NORTH OLMSTED ORDINANCE NO. 2016 — 63 BY: Mayor Kennedy AN ORDINANCE AMENDING AND RE-ESTABLISHING CHAPTER 131.07 AND 131.99(D) OF THE ADMINISTRATIVE CODE, ENTITLED "DIVISION OF MAYOR'S COURT" AND "COMPOSITION AND ORGANIZATION OF THE OFFICE OF MAYOR," RESPECTIVELY, IN ORDER TO PROVIDE FOR AN ADDITIONAL PART-TIME MAGISTRATE AND AN ACTING MAGISTRATE, AND DECLARING AN EMERGENCY WHEREAS, this Council via Ordinance 2013-03 established the organization of the Division of Mayor's Court, including Organizational Charts, for the purpose of, among other things, organizing and / or stating the employee complement within the Division of Mayor's Court; and WHEREAS, Mayor Kennedy desires to create a separate court docket to handle income tax and building code prosecutions, thereby requiring an additional Magistrate; and WHEREAS, on occasion, the regular, part-time Magistrates have been conflicted and cannot preside, thereby leaving the Court without a Magistrate for the regularly scheduled Court session; and WHEREAS, an as —needed, acting Magistrate would assist and fill in on the occasions when Magistrates are unavailable; and WHEREAS, it is the desire of this Council to implement the organizational changes recommended by Mayor Kennedy as set forth herein. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Chapter 131.07 "Division of Mayor's Court" which presently reads as follows: 131.07 DIVISION OF MAYOR'S COURT. There is hereby established a Division of Mayor's Court within the Office of Mayor. The Division of Mayor's Court shall be headed by the Mayor. It shall be staffed by up to two (2) part- time Magistrates of the Mayor's Court, one (1) full time Clerk of the Mayor's Court, and up to two (2) Assistant Clerks of the Mayor's Court. All positions shall be appointed by and be answerable to the Mayor. (a) Duties.
