CITY OF NORTH OLMSTED ORDINANCE NO. 2016 — 77 By: Mayor Kennedy AN ORDINANCE AUTHORIZING THE MAYOR AND FINANCE DIRECTOR TO ENTER INTO AN AMENDMENT OF THE SEWER SERVICE AREA DEFINED BY EXHIBIT B OF THE SEWER SERVICE AGREEMENT WITH THE COUNTY OF CUYAHOGA, AS AMENDED AND RESTATED IN 2013. WHEREAS, pursuant to authorization granted by Council by Ordinance 2013-88, the City negotiated amendment of and restated its Sewer Service Agreement with Cuyahoga County in order to coincide with major capital improvements to the Wastewater Treatment Plant serving the City and a portion of Cuyahoga County's Sewer District No. 14; and WHEREAS, the City is authorized by Sections 3, 4 and 6 of Article XVIII of the Ohio Constitution and the County, by its Charter and the Ohio Revised Code, including Chapter 6117 and Sections 307.15 and 6117.41 thereof, to enter into further amendments, as may be necessary and appropriate, and to restate said Sewer Service Agreement with Cuyahoga County; and WHEREAS, by reason of discussion between the Cuyahoga County Engineer, the City of North Olmsted Engineer, in coordination with NOACA and the Olmsted Township Trustees, and of other relevant considerations, the City and the County of Cuyahoga (the County) have determined it to be necessary and appropriate to revise and update the Service Area Map defined and described by Exhibit B of the Sewer Service Agreement, as Amended and Restated in 2013, and thereby to identify and remove four (4) additional parcels of land located on Bronson Road, to be excluded from sewer services provided by the North Olmsted Wastewater Treatment Plant; and WHEREAS, representatives of the City and the County have negotiated a proposed form of said Exhibit B to update and amend the Service Area, dated July 11, 2016, consisting of both a narrative description and a mapped area, a copy of which is attached; and WHEREAS, this Council has determined to approve the further amendment of the Sewer Service Agreement in order to reduce the service area as shown in revised Exhibit B dated July 11, 2016. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: The Mayor and the Director of Finance are authorized and directed to sign and deliver, in the name and on behalf of the City and in their official capacities, an Amended and Restated Sewer Service Agreement between the City and the County of Cuyahoga in substantially the form now on file with the Clerk of Council.
