CITY OF NORTH OLMSTED RESOLUTION NO. 2016 — 92 By: Mayor Kennedy A RESOLUTION AUTHORIZING THE DIRECTOR OF PLANNING AND DEVELOPMENT TO MAKE APPLICATION ON BEHALF OF THE CITY OF NORTH OLMSTED TO PARTICIPATE IN THE OHIO PUBLIC WORKS COMMISSION STATE CAPITAL IMPROVEMENT AND/OR LOCAL TRANSPORTATION IMPROVEMENT PROGRAMS AND FURTHER AUTHORIZING THE MAYOR TO ACCEPT THE FUNDS IF AWARDED AND TO EXECUTE CONTRACTS AS REQUIRED, AND DECLARING AN EMERGENCY. WHEREAS, the State Capital Improvement Program and the Local Transportation Improvement Program both provide financial assistance to political subdivisions for capital improvements to public infrastructure; and WHEREAS, the City of North Olmsted is planning to make capital improvements to Butternut Ridge Road; and WHEREAS, the infrastructure improvement herein above described is considered to be a priority need for the community and is a qualified project under the OPWC programs; and WHEREAS, it is accordingly the desire of this Council to authorize the Director of Planning and Development to make application for the Ohio Public Works State Capital Improvement Program and / or the Local Transportation Improvement Program. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That Planning and Development Director Kimberly Wenger is hereby authorized to apply to the OPWC for funds as described above. SECTION 2: That the Mayor be, and he hereby is, authorized to accept the funds on behalf of the City of North Olmsted and to execute a contract for the same, if required, SECTION 3: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety, and welfare, and for the further reason it is necessary that this legislation go into effect immediately in order that the City may make a timely application for funds on or before September 23, 2016, and further, provided it receives the affirmative vote of two-thirds of all members of the Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
