installation of these facilities by service providers and/or public utilities and is further necessary <br />to prevent unregulated proliferation of said facilities through the issuance of a permit prior to <br />reasonable regulations. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: For the reasons stated in the preamble to this ordinance, this Council <br />declares a moratorium on review of applications for and the issuance of permits under Chapters <br />1151 and 902 of the Codified Ordinances of North Olmsted, Ohio, for the placement of above <br />ground communication facilities in the public right-of-way for a period commencing on the <br />effective date of this ordinance and ending on either the effective date of an ordinance adopting <br />new or amended regulations for such installations or six (6) months from the effective date <br />hereof, whichever date occurs first. <br />SECTION 2: That Council and the Administration shall not formally act upon any <br />applications for such above ground communication facilities, collocation, construction and/or <br />modification of poles, towers, non -tower supporting structures, antennas, base stations, <br />equipment cabinets, underground vaults and transmission equipment in the rights-of-way for a <br />period of one hundred eighty days (180) days from the effective date of this ordinance. <br />SECTION 3: It is found and determined that all formal actions of this Council <br />concerning and relating to the adoption of this Ordinance were adopted in an open meeting of <br />this Council, and that all deliberations of this Council and of any of its committees that resulted <br />in such formal action, were in meetings open to the public, in compliance with all legal <br />requirements, including Section 121.22 of the Ohio Revised Code. <br />SECTION 4: This Resolution is declared to be an emergency measure immediately <br />necessary for the preservation of the public peace, health, safety and general welfare of the <br />citizens and visitors of the City of North Olmsted, and for further reason that it is immediately <br />necessary in order for this Council to consider reasonable regulation of the installation of <br />wireless communication facilities and appurtenant tower or pole installations and prevent <br />unregulated proliferation of these facilities.
