CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2016 —115 <br />BY: Council Member Williamson <br />AN ORDINANCE AMENDING AND RE-ESTABLISHING SECTION <br />505.071 ENTITLED "CRUELTY TO COMPANION ANIMALS" OF <br />CHAPTER FIVE OF THE CODIFIED ORDINANCES OF THE CITY OF <br />NORTH OLMSTED IN ORDER TO INCORPORATE NEW STANDARDS <br />AND PENALTIES ADOPTED BY STATE LAW, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the General Assembly recently adopted Substitute House Bill 60 which <br />included amendments to Revised Code 959.131 and 959.132 regarding standards and penalties <br />for the offense of Cruelty to Companion Animals; and <br />WHEREAS, the new law has been referred to as Goddard's Law in recognition of the <br />efforts of local weatherman, Dick Goddard, who championed the cause of greater protection of <br />companion animals; and <br />WHEREAS, Section 505.071 of the General Offenses Code provides for the offense of <br />Cruelty to Companion Animals, which can be readily amended to incorporate the new standards <br />and penalties now imposed by State Law; and <br />WHEREAS, in order to promote and provide for the public health, safety and general <br />welfare of all citizens and to protect companion animals from acts of cruelty, it is the desire of <br />this Council Administration to amend and re-establish Section 505.071 of the General Offenses <br />Code. <br />.NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 505.071 "Cruelty to Companion Animals" which presently <br />reads in its entirety as set forth in Exhibit A, which is attached to this Ordinance and <br />incorporated by reference as if fully rewritten herein, shall be amended and, as amended, shall <br />read in its entirety as such amendments are displayed by boldface and as stricken in Exhibit B. <br />SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with <br />this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or <br />inconsistent provisions of any Ordinance shall be corrected at re -codification. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Ordinance to go into effect immediately in order to <br />provide for immediate enforcement of regulations and to maintain compliance with animal <br />control requirements; and further provided it receives the affirmative vote of two-thirds of all <br />
