CITY OF NORTH OLMSTED ORDINANCE NO. 2016 —116 By: Mayor Kennedy AN ORDINANCE AMENDING VARIOUS SECTIONS OF CHAPTER NINE FIFTY OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED TITLED "URBAN FOREST" FOR THE PURPOSE OF (1) REMOVING REFERENCE TO THE PREVIOUSLY ABOLISHED ARCHITECTURAL REVIEW BOARD; AND (2) REASSIGNING, WHEN APPROPRIATE, DUTIES PREVIOUSLY ASSIGNED TO THE NOW -ABOLISHED BOARD, AND DELCARING AN EMERGENCY. WHEREAS, Chapter 950 of the Codified Ordinances of the City of North Olmsted continues to reference the previously abolished Architectural Review Board; and WHEREAS, it is the recommendation of the Director of Planning and Development and the Director of Law that the Streets, Utilities and Public Services Code at "Urban Forest" be amended to remove reference to the abolished Architectural Review Board; and WHEREAS, it is the desire of this Council to otherwise amend the Code in order to remove reference to abolished boards and commissions. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Sections 950.02 and 950.03, which presently read as follows: 950.02 DUTIES AND POWERS OF CITY FORESTER. The City Forester shall be vested with the following duties and powers: (a) To enforce or cause to be enforced the provisions of this chapter. (b) To enforce arboricultural specifications and standards of practice generally accepted by the arboriculture trade, which shall govern the selection, planting, maintenance, production and removal of public, commercial and multi -family residential trees and utilization of wood and forest products produced in the course of operation. (c) To issue orders and permits for planting, maintenance, protection and removal of public, commercial and multi -family residential trees and, where applicable, to make site inspections and enforce conditions imposed upon landscaping plans and/or upon tree preservation/removal permits issued pursuant to this chapter and as otherwise imposed upon development plans and commercial building permits pursuant to Chapter 1126.
