CITY OF NORTH OLMSTED ORDINANCE NO. 2016 —121 BY: Mayor Kennedy, Council President Jones and Council Member Barker AN ORDINANCE AMENDING SECTION 351.11 OF CHAPTER 351 (PARKING GENERALL I) OF THE TRAFFIC CODE, ENTITLED "PARKING OF UNAUTHORIZED VEHICLES IN RESIDENTIAL AND BUSINESS DISTRICTS; IMPOUNDING" IN ORDER TO PROHIBIT PARKING OF TRUCKS AND TO OTHERWISE REGULATE PARKING VEHICLES ON RESIDENTIAL PROPERTY. WHEREAS, Section 351.11 of the Traffic Code currently prohibits the parking of specified trucks and other commercial vehicles on City streets in front of or alongside of property zoned or used for residential purposes, with limited exceptions for delivery purposes and in case of emergency breakdown; and WHEREAS, likewise Section 1161.07 of the Zoning Code also prohibits the parking or storage of specified trucks and other commercial vehicles in residential zoning districts; and WHEREAS, in addition, this Council is informed that property maintenance violations with respect to vehicular parking, as contained in Section 1363.302.9, may be committed on evening and weekends, beyond the routine observations of building officials but readily observable by police officers on patrol; and WHEREAS, this Council is advised that such regulation of parking may be lawfully contained in the Building, Zoning and Traffic Codes and subject to enforcement by the Safety Department; and WHEREAS, it is the desire of this Council to expand the prohibitions of Section 351.11 in order to prohibit the parking of trucks and other violations on residential properties so that the Traffic Code is consistent with the Building and Zoning Codes; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Section 351.11 of Chapter 351 (Parking Generally) of the Traffic Code, which presently reads as follows: 351.11 PARKING OF UNAUTHORIZED VEHICLES IN RESIDENTIAL AND BUSINESS DISTRICTS; IMPOUNDING. (a) No person shall park a truck with a gross vehicle weight (GVW) of 10,000 pounds or more, commercial tractor, bus, trailer or semitrailer, on any street or roadway, nor the berm or right of way thereof, at any time in front of or alongside of property zoned or used for residential purposes except in case of a breakdown or for loading or unloading purposes.
