EXHIBIT A: EXISTING CHAPTER 927 <br />927.05 STREETS UTILITIES AND PUBLIC SERVICES CODE 66J <br />(12) Storm sewer and other drainage outlets. All storm sewers, footer drains, <br />roof gutter drains and all other drains will be outletted at the bottom of the <br />slope. The slope below the outlet will be able to control the water being <br />drained through the storm sewer or other drains without causing erosion of <br />the stream or channel banks or channel bottom. If required due to the <br />velocity of the storm water from the outlet, rock channel protection shall <br />be placed for erosion control. <br />(13) Establishment of permanent vegetation. A permanent vegetation cover <br />shall be established on denuded areas not otherwise permanently <br />stabilized. <br />Permanent vegetation shall not be considered established until ground <br />cover is achieved which, in the opinion of the City Engineer, provides <br />adequate cover and is mature enough to control soil erosion satisfactorily <br />and to survive adverse weather conditions. <br />(14) Disposition of temporary practices. All temporary and permanent erosion <br />and sediment control practices shall be disposed of within thirty (30) days <br />after final site stabilization is achieved or after the temporary practices are <br />no longer needed, unless otherwise authorized by the Engineering <br />Division. Trapped sediment shall be permanently stabilized to prevent <br />further erosion. <br />(15) Maintenance. All temporary and permanent erosion and sediment control <br />practices and facilities shall be maintained and repaired by the owner or <br />person in charge of the parcel of land on which such facilities are located <br />as needed to assure continued performance of their intended function. <br />(16) Special provision. Standard Number (5), Storm Sewer Inlet Protection, <br />and Standard Number (7), Construction Access Routes, apply to all earth - <br />disturbing activity regardless of lot size. <br />(17) Inspections. <br />(A) If inspections or other information indicates a control has been <br />used inappropriately or incorrectly or it has failed, it must be <br />replaced or modified for the site conditions. <br />(B) The owner of the development area shall have the site inspected <br />for soil erosion, sediment control and other environmental <br />concerns every seven (7) calendar days, and within twenty-four <br />(24) hours of a 0.5 inch or greater rainfall event until the <br />Community Engineer certifies the site as being stable. The <br />Community Engineer certification does not relieve the permittee <br />from meeting the Ohio EPA NPDES Inspection Requirements. <br />(C) The inspection frequency may be reduced to at least once every <br />month if the entire site is temporarily stabilized for runoff is <br />unlikely due to weather conditions (e.g., the site is covered with <br />snow, ice, or the ground is frozen). A waiver of inspection <br />requirements is available until one month before thawing <br />conditions are expected to result in a discharge if all of the <br />following conditions are met: the project is located in an area <br />where frozen conditions are anticipated to continue for extended <br />periods of time (i.e., more than one month); land disturbance <br />activities have been suspended; and the beginning and ending dates <br />of the waiver period are documented. Once a definable area has <br />been fully stabilized, you may mark this on your plans and no <br />further inspection requirements apply to that portion of the site. <br />
