Public Hearing of 10-11-2016 <br />Council did not have any questions for Director Wenger at this time. <br />AUDIENCE PARTICIPATION <br />Bruce Bruehler <br />4440 Root Road <br />North Olmsted <br />Mr. Bruehler stated his property is completely along the Ganley's property and in 1986 <br />Council guaranteed the property in question would remain residential forever. In addition <br />to the potential agreement in 1986, he is also concerned that North Olmsted is setting a <br />precedent by taking property that is in no way connected to the Lorain Road Corridor and <br />turning it into commercial property for the benefit of Ganley. He asked what the benefit <br />of this is to the city and the residents and stated if the City does this and he was a resident <br />of any other street that touches Lorain road that he would be scared because this will <br />continue throughout the city. <br />Mayor Kennedy responded to him saying they had talked privately in the past about this <br />deal that was made in 1986 and asked him what it was and if it was a signed agreement. <br />Mr. Bruehler responded that in the January 1986 Council records, the parcel in question <br />was turned into a residential piece of land when the Lube Stop went in. He said <br />unfortunately the records back then did not show the audience participation, but that is <br />when it was turned into residential. Responding to the question of who guaranteed it by <br />the Mayor, he said he was not sure who it was in 1986, but they were promised by <br />Council it would remain residential. That was why they formed it and put the frontage on <br />Root Road, not Lorain. <br />Mr. Bruehler continued that six years ago Ganley took residential property against the <br />citizens' wishes and the City turned it into commercial property because Mr. Gareau said <br />there was precedent in another city. The only promise they received was Ganley would <br />not build buildings on the newly zoned parcel. He wants to know what will stop North <br />Olmsted from continuing to do what they are about to do once they set this precedent. <br />Councilman Brossard asked to respond and prefaced his comment by saying he is in no <br />way saying Mr. Bruehler's assertion is not correct in saying that an agreement might have <br />taken place in 1986, however, Council took the matter so seriously they asked the clerk to <br />do her due diligence and the Clerk was unable to find anything. He said perhaps that is <br />because record keeping just was not up to par. <br />Mr. Bruehler responded that if you looked at the item numbers in January of 1986 you'd <br />see the property was changed to residential and the frontage was purposely put on Root <br />Road and now council is going to go in the opposite direction and he does not see the <br />benefit to the City or its residents. <br />Councilwoman Williamson asked Director Wenger if this rezoning is being done to make <br />everything conform with the rest of the property. <br />NA <br />
