CITY OF NORTH OLMSTED ORDINANCE NO. 2016 - 128 By: Mayor Kennedy AN ORDINANCE ACCEPTING A PERMANENT EASEMENT ON PERMANENT PARCEL NUMBER 234-15-008 FROM THE NORTH OLMSTED BOARD OF EDUCATION FOR THE PURPOSE OF INSTALLING AND MAINTAINING TRAFFIC SIGNAL EQUIPMENT, AND DECLARING AN EMERGENCY. WHEREAS, the City is undertaking a comprehensive upgrade to the traffic signal system with construction set to begin in the Spring of 2017; and WHEREAS, the City will replace aged equipment and upgrade the City's closed-loop signal system to a central based control system; and WHEREAS, upgrading the system will require the replacement of some controller equipment, signal support poles, underground conduit, control boxes, wiring and other interconnect equipment; and WHEREAS, new equipment includes a radar activation system, new software controllers, and a pre-emption system to ensure that police and fire emergency personnel can safely navigate the City streets; and WHEREAS, relocated equipment for the Chestnut School traffic signal will fall outside the Right of Way, thereby necessitating an easement on Board of Education Property; and WHEREAS, the City has negotiated for the voluntary acquisition of this permanent easement; and WHEREAS, it is the desire of this Council, upon the advice and recommendation of the Director of Law and the City Engineer, to accept the easement and to provide for the recording of such conveyance. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor is hereby authorized and directed to accept, on behalf of the City of North Olmsted, a Permanent Easement from the North Olmsted Board of Education, the owner of Parcel 234-15-008, as further described within said document, marked as Exhibit A attached hereto and incorporated herein by reference.
