CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2016 -130 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTION 1363.302 OF CHAPTER 1363 OF <br />THE BUILDING CODE ENTITLED "PROPERTY MAINTENANCE" IN <br />ORDER TO PROVIDE ADDITIONAL MAINTENANCE REQUIREMENTS <br />FOR OUTDOOR TELEPHONE PAYSTATIONS. <br />WHEREAS, cellular communications technology has rendered the traditional outdoor <br />telephone pay station nearly obsolete; and <br />WHEREAS, with the advance of technology in the City of North Olmsted, abandoned <br />outdoor telephone booths, enclosures, telephones, telephone mast arms and bollards protecting <br />the same have arisen, causing unnecessary clutter, thereby creating a blighting influence; and <br />WHEREAS, this Council determines and so finds that abandoned outdoor telephone pay <br />stations are a nuisance that should either be restored to working condition, or removed from the <br />property; and <br />WHEREAS, this Council finds that poorly maintained structures and premises in the City <br />of North Olmsted create a blighting influence that is a detriment to the public health, safety and <br />welfare of all property owners in the City; and <br />WHEREAS, it is the recommendation of the Administration that a new and revised <br />Section 1363.302 of Chapter 1363 of the Building Code of the City of North Olmsted entitled <br />"Property Maintenance" be adopted; and <br />WHEREAS, it is the desire of this Council, consistent with the recommendations of the <br />Administration, to establish a new and revised property maintenance standard for outdoor <br />telephone pay stations within the City of North Olmsted. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 1363.302 "Exterior Property Areas" of Chapter 1363 <br />"Property Maintenance," which presently reads in its entirety as follows: <br />1363.302 EXTERIOR PROPERTY AREAS <br />1363.302.1 Sanitation <br />All exterior property and premises shall be maintained in a clean, safe and sanitary condition free <br />from any accumulation of rubbish or garbage. No person shall erect, continue to use, or maintain <br />a building, structure, or place for the exercise of a trade, employment, or business or for keeping <br />
