CITY OF NORTH OLMSTED ORDINANCE NO. 2016 -138 By: Mayor Kennedy AN ORDINANCE ACCEPTING A PERMANENT EASEMENT FOR THE INSTALLATION AND MAINTENANCE OF A STORMWA TER SEWER AND DRAINAGE DITCH ON PERMANENT PARCEL NUMBER 231-09-023 FROM JEFFREY AND LAURA STURGEON FOR THE PURPOSE OF PROVIDING STORMWA TER DRAINAGE SERVICES, AND DECLARING AN EMERGENCY. WHEREAS, the City has, for some period of time, over the course of several years, undertaken the maintenance of a natural watercourse or creek and ditch, in conjunction with the City's stormwater drainage system, in the general vicinity of the intersection of Alexander and West 231St Street, specifically including the backland of property now owned by Jeffrey and Laura Sturgeon, located at 3092 West 231St, (PP# 231-09-023),; and WHEREAS, the property owners, Jeffrey and Laura Sturgeon, have recently acquired title to this backland by virtue of a Lot Split and Consolidation with their neighbor, Carol George, 23165 Alexander (PP#231-06-014 & 017), and have graciously offered this Permanent Easement to the City in order to ratify the City's perpetual right of way for the purpose of providing stormwater drainage services; and WHEREAS, the property owners, Jeffrey and Laura Sturgeon, have worked with the administration, including officials in Service, Wastewater, Engineering, and Law to address numerous details, have engaged the services of professionals at their own cost, and the City is grateful for their ongoing efforts to voluntarily relinquish this Permanent Easement; and WHEREAS, it is the desire of this Council, upon the advice and recommendation of the Director of Law and the City Engineer, to accept the easement and to provide for the recording of such conveyance. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor is hereby authorized and directed to accept, on behalf of the City of North Olmsted, a Permanent Easement from Jeffrey and Laura Sturgeon, the owners of Parcel 231-09-023, as further described within said document, marked as Exhibit A attached hereto and incorporated herein by reference. SECTION 2: That the Engineer of the City of North Olmsted is hereby directed to cause said easement to be recorded in the Office of the Cuyahoga County Recorder / Fiscal Officer.
