NOW THEREFORE, the CITY and CONTRACTOR, each acknowledging the sufficiency of the consideration contained in the terms and conditions of the Agreement, agree as follows: SECTION 1. BASIC SERVICES. 1.1 The SERVICES required to be performed by CONTRACTOR under this Agreement shall be such basic services as are described expressly or by reference in Exhibit I (Scope of Services) and Exhibit IV (Contractor's Quotation), attached hereto and made a part hereof. It is acknowledged that the drawings identifying the Scope of Services were not prepared by CONTRACTOR. The CITY warrants that the plans and specifications comply with the requirements of state and local regulations and that CONTRACTOR may rely upon the accuracy of same. SECTION 2. ADDITIONAL SERVICES. 2.1 Subject to the provisions in Section 6 relating to changes within the general scope of this Agreement in the SERVICES to be performed, no additional services are expected to be required by CONTRACTOR for the PROJECT. However, should the providing of any additional services outside the general scope of this Agreement become necessary, any such additional required services outside the general scope of this Agreement will be separate from the Section 1 - Basic Services, and will be considered an Optional Service that may be undertaken only upon written authorization by the CITY. SECTION 3. CITY'S RESPONSIBILITIES. 3.1 The CITY shall do the following in a timely manner: 3.1.1 The CITY representative shall be the Mayor, who shall have the authority to give to CONTRACTOR instructions, receive information, define the CITY'S policies and make decisions with respect to the PROJECT. All questions, concerns, and information will first be forwarded to the Architect, who in turn will forward and coordinate with the City Representative.
