CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2017 - 18 <br />BY: Mayor Kennedy <br />AN ORDINANCE CREATING A PERPETUAL EASEMENT FOR <br />TRAFFIC CONTOL PURPOSES IN THE NAME OF AND FOR THE <br />USE BY THE CITY OF NORTH OLMSTED, ON REAL PROPERTY <br />AT 24291 LORAIN ROAD AND DECLARING AN EMERGENCY. <br />WHEREAS, the City is undertaking a comprehensive upgrade of the traffic <br />control system in the City of North Olmsted; and <br />WHEREAS, the City of North Olmsted, as required by the Ohio Department of <br />Transportation, desires a perpetual easement for the installation and operation of traffic <br />signal control equipment on property owned by the City of North Olmsted (Fire Station <br />No. 1), outside the right-of-way; and <br />WHEREAS, the perpetual easement will be on real property at 24291 Lorain <br />Road, North Olmsted, Ohio, and which is identified as Permanent Parcel Number 237- <br />04-002 in the Office of the Cuyahoga County Fiscal Officer; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor, on behalf of <br />the City, to accept and create such easement so that the City may install, reinstall and <br />maintain the traffic signal equipment in perpetuity, within the said Easement area; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLSMTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to create, on behalf <br />of the City of North Olmsted, a perpetual Traffic Signal Control Equipment Easement on <br />property owned by the City of North Olmsted, at 24291 Lorain Road, North Olmsted, <br />Ohio, and known as Permanent Parcel Number 237-04-002. A copy of said Easement is <br />attached to this Ordinance as Exhibit A. <br />SECTION 2: That the Engineer of the City of North Olmsted is hereby directed <br />to cause the fully -executed original of said Easement document to be recorded in the <br />Office of the Cuyahoga County Fiscal Officer. <br />SECTION 3: That this Resolution is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, safety and <br />welfare, and for the further reasons that the easement must be in effect to insure project <br />timelines and avoid right-of-way conflicts, and further provided it receives the <br />
