CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2017 -17 <br />BY: Councilman Limpert <br />AN ORDINANCE AMENDING SECTION 1363.302.2 OF CHAPTER 1363 <br />OF THE REAL PROPERTY MAINTENANCE CODE ENTITLED <br />"DISCARDED MATERIALS" IN ORDER TO PROVIDE STANDARDS FOR <br />TRASH RECEPTACLES ON COMMERCIAL PROPERTIES. <br />WHEREAS, the Real Property Maintenance Code provides standards for the <br />maintenance of premises, including considerations for health, safety and general welfare of <br />property owners; and <br />WHEREAS, additional maintenance standards regulating trash receptacles will eliminate <br />unsightly conditions and blighting influences in the community; and <br />WHEREAS, this Council desires to amend Section 1363.302.2 of the Codified <br />Ordinances in order to adopt and enforce trash receptacle standards. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 1363.302.2 of Chapter 1363 of the Real Property <br />Maintenance Code, which presently reads as follow: <br />1363.302.2 Discarded materials <br />All exterior property and premises shall be maintained free of discarded materials. <br />BE AMENDED AND AS AMENDED SHALL READ AS FOLLOWS: <br />1363.302.2 Discarded materials <br />All exterior property and premises shall be maintained free of discarded materials. <br />Commercial property owners shall provide adequate trash receptacles for customer use to <br />maintain the premises free of trash and rubbish. Repeated failures to maintain the <br />premises free of discarded materials may result in the City requiring the provision of or <br />addition of trash receptacles. <br />SECTION 2: That this Ordinance shall take effect and be in force from and after the <br />earliest period allowed by law upon its passage and approval by the Mayor. <br />
