CITY OF NORTH OLMSTED RESOLUTION NO. 2017 - 25 By: Mayor Kennedy A RESOLUTION DISPENSING WITH THE REQUEST FOR PROPOSAL (R.F.P.) PROCESS REQUIRED TO OBTAIN THE SERVICES OFA VENDOR TO PROVIDE PLUMBING AND HVAC PREVENTATIVE MAINTENANCE SERVICES AT THE RECREATION CENTER AND AUTHORIZING THE MAYOR TO ENTER INTO A TWO (2) YEAR CONTRACT WITH THE BREWER- GARRETT COMPANY, AND DECLARING AN EMERGENCY. WHEREAS, this Council previously authorized the Mayor to request proposals for a vendor to provide plumbing and HVAC preventative maintenance services at the Recreation Center; and WHEREAS, The Brewer -Garrett Company was selected in the R.F.P. process and has provided those services to the City for the past two (2) years, delivering excellent service at reasonable cost; and WHEREAS, the current contract expires on March 31, 2017; and WHEREAS, the Mayor has requested that this Council dispense with provisions of Chapter 112 of the North Olmsted Codified Ordinances, requiring a R.F.P. process to select the City's HVAC vendor and further requests that the Council authorize the Mayor to enter into a two (2) year contract with The Brewer -Garrett Company to provide such service; and WHEREAS, in accordance with the recommendation of the Director of Planning and Development, it is the desire of this Council to dispense with the R.F.P. process to select an HVAC / plumbing vendor and, further, to authorize the Mayor to enter into a two (2) year contract with The Brewer -Garrett Company to serve as the HVAC and plumbing preventative maintenance vendor for the Recreation Center. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMS TED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION l: That the Mayor be and he hereby is authorized to enter into a two (2) year contract with The Brewer -Garrett Company to provide services to the Recreation Center, as an exception under North Olmsted Codified Ordinance § 112.10(b). Said contract shall be in substantially the same form and substance as the contracts attached hereto as Exhibit A, with only such changes thereto as are not substantially adverse to the City and which are approved by the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the agreement by the Mayor and the approval of the agreement by the Director of Law.
