CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2017 - 25 <br />By: Mayor Kennedy <br />A RESOLUTION DISPENSING WITH THE REQUEST FOR <br />PROPOSAL (R.F.P.) PROCESS REQUIRED TO OBTAIN THE <br />SERVICES OFA VENDOR TO PROVIDE PLUMBING AND HVAC <br />PREVENTATIVE MAINTENANCE SERVICES AT THE <br />RECREATION CENTER AND AUTHORIZING THE MAYOR TO <br />ENTER INTO A TWO (2) YEAR CONTRACT WITH THE BREWER- <br />GARRETT COMPANY, AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council previously authorized the Mayor to request proposals for <br />a vendor to provide plumbing and HVAC preventative maintenance services at the <br />Recreation Center; and <br />WHEREAS, The Brewer -Garrett Company was selected in the R.F.P. process and <br />has provided those services to the City for the past two (2) years, delivering excellent <br />service at reasonable cost; and <br />WHEREAS, the current contract expires on March 31, 2017; and <br />WHEREAS, the Mayor has requested that this Council dispense with provisions of <br />Chapter 112 of the North Olmsted Codified Ordinances, requiring a R.F.P. process to select <br />the City's HVAC vendor and further requests that the Council authorize the Mayor to enter <br />into a two (2) year contract with The Brewer -Garrett Company to provide such service; <br />and <br />WHEREAS, in accordance with the recommendation of the Director of Planning <br />and Development, it is the desire of this Council to dispense with the R.F.P. process to <br />select an HVAC / plumbing vendor and, further, to authorize the Mayor to enter into a two <br />(2) year contract with The Brewer -Garrett Company to serve as the HVAC and plumbing <br />preventative maintenance vendor for the Recreation Center. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMS TED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION l: That the Mayor be and he hereby is authorized to enter into a two <br />(2) year contract with The Brewer -Garrett Company to provide services to the Recreation <br />Center, as an exception under North Olmsted Codified Ordinance § 112.10(b). Said <br />contract shall be in substantially the same form and substance as the contracts attached <br />hereto as Exhibit A, with only such changes thereto as are not substantially adverse to the <br />City and which are approved by the Director of Law. The character of any such changes as <br />not being substantially adverse to the City shall be evidenced conclusively by the execution <br />of the agreement by the Mayor and the approval of the agreement by the Director of Law. <br />
