33 <br />CHAPTER 1118 <br />Conditional Use Permit <br />1118.01 Intent. 1118.05 Expiration. <br />1118.02 Procedure. 1118.06 Revocation. <br />1118.03 General criteria and standards. <br />1118.04 Special conditions and <br />standards. <br />CROSS REFERENCES <br />Conditional use defined - see P. & Z. 1115.10 <br />1118.01 INTENT. <br />Certain uses more intensely affect the surrounding area in which they are located than <br />permitted uses in the same zoning district. If properly controlled and regulated, these uses can <br />be compatible within the zoning district. To provide this necessary control such uses shall be <br />designated as conditional uses and allowable only upon review and granting of a conditional <br />use permit by City Council. Because of the uniqueness or special nature of a conditional use <br />with respect to location, design, size, and method of operation, each such use that comes under <br />review shall be considered individually. <br />(Ord. 2006-162. Passed 1-2-07.) <br />1118.02 PROCEDURE. <br />(a) Application. Any owner of property in the City may submit an application to <br />the Building Official requesting a conditional use permit. The applicant shall follow the <br />submission procedures set forth in Chapter 1126 Commercial and Other Building Permits. <br />Any completed application received for such a permit shall be submitted by the Building <br />Official to the Planning and Design Commission. <br />(b) Hearing. The Commission shall hold a hearing on such application within thirty <br />days from the date of receiving such application. Notice of the hearing shall be provided by <br />the Clerk of Commissions as required in the Administrative Code Chapter 149. <br />(c) Approval. The Planning and Design Commission, upon making a finding, shall <br />forward the application and a report of its findings to Council for its confirmation. In <br />approving or disapproving an application, Council may take such additional testimony or <br />evidence as may be of assistance to its determination. <br />(Ord. 2006-162.
