33 CHAPTER 1118 Conditional Use Permit 1118.01 Intent. 1118.05 Expiration. 1118.02 Procedure. 1118.06 Revocation. 1118.03 General criteria and standards. 1118.04 Special conditions and standards. CROSS REFERENCES Conditional use defined - see P. & Z. 1115.10 1118.01 INTENT. Certain uses more intensely affect the surrounding area in which they are located than permitted uses in the same zoning district. If properly controlled and regulated, these uses can be compatible within the zoning district. To provide this necessary control such uses shall be designated as conditional uses and allowable only upon review and granting of a conditional use permit by City Council. Because of the uniqueness or special nature of a conditional use with respect to location, design, size, and method of operation, each such use that comes under review shall be considered individually. (Ord. 2006-162. Passed 1-2-07.) 1118.02 PROCEDURE. (a) Application. Any owner of property in the City may submit an application to the Building Official requesting a conditional use permit. The applicant shall follow the submission procedures set forth in Chapter 1126 Commercial and Other Building Permits. Any completed application received for such a permit shall be submitted by the Building Official to the Planning and Design Commission. (b) Hearing. The Commission shall hold a hearing on such application within thirty days from the date of receiving such application. Notice of the hearing shall be provided by the Clerk of Commissions as required in the Administrative Code Chapter 149. (c) Approval. The Planning and Design Commission, upon making a finding, shall forward the application and a report of its findings to Council for its confirmation. In approving or disapproving an application, Council may take such additional testimony or evidence as may be of assistance to its determination. (Ord. 2006-162. Passed 1-2-07.)
