1126.10 PLANNING AND ZONING CODE 54D <br />(2) The Director of Planning shall have authority to approve or reject minor <br />change applications. <br />A. The Director of Planning shall forward all completed applications <br />to the Chair of the Building, Zoning and Development Committee <br />of Council and the Chair of the Planning and Design Commission <br />for their review and comment. <br />B. In considering any completed application, the Director of <br />Planning shall solicit input from the Planning and Design <br />Commission architect and/or the Planning and Design <br />Commission landscape professional, as well as any affected City <br />official and/or City department. <br />(3) Within ten business days of the application filing, the Director of <br />Planning shall notify the applicant and the Building Official whether the <br />minor change application is approved or rejected. <br />(Ord. 2006-130. Passed 10-17-06.) <br />1126.10 EXPIRATION OF APPROVAL AND EXTENSION OF TIME. <br />(a) After any development plan or application for a building permit has been finally <br />approved by Council, or approved with respect to a minor change as provided for in Section <br />1126.08, <br />the applicant shall take all necessary steps and meet all legal requirements in order to <br />timely obtain a building permit from the Building Official. In the event that the applicant fails <br />to obtain a permit within one (1) year of final approval as set forth above, the approval shall <br />expire unless the Director of Planning and Development, upon timely application, <br />administratively extends for a period of up to one (1) year the previous approval rendered by <br />the Council or the Director of Planning and Development pursuant to Section 1126.08. Such <br />application shall be approved unless one of the following circumstances are present: <br />(1) The applicable zoning regulations have been amended; or <br />(2) The extension of time is based upon a new development plan or an <br />amendment to the final, approved development plan; or <br />(3) The property has been cited by the Building Official for any building, <br />zoning or real property maintenance code violation and the violation <br />remains outstanding at the time of application. <br />(b) The failure of the Director to grant such request is final and not subject to <br />review. Passed 2-15-11.) <br />1126.11 SITE DEVELOPMENT PLAN AND BUILDING ELEVATION <br />CERTIFICATIONS; DEVIATIONS FROM APPROVED FINAL <br />DEVELOPMENT PLANS PROHIBITED. <br />(a) Any owner who, after receiving Council approval of final development plans or <br />Building or Engineering Department approval of site development plans and/or building <br />elevations, or receiving a building permit pursuant to the provisions of this chapter, or <br />obtaining an authorized deviation from an approved final development, site development plan <br />or building elevations, as provided for in paragraph (d) below, and who develops the subject <br />property and/or constructs buildings and other land improvements on the property, but fails to <br />do so in strict compliance with the plans as approved or authorized, shall be subject to all of <br />the actions by the City authorized by Chapter 1121 and to the criminal penalties provided for <br />in Section 1121.99(b). <br />December 2016 Replacement <br />
