Administration and Enforcement <br />Section 1117.01 Administration and Enforcement <br />A. Administration. The duty of administering the provisions of the Zoning Code is hereby <br />conferred upon the Planning and Development Director. <br />1. He/she may be provided with the assistance of other persons as the City may direct. <br />2. In carrying out the administrative duties of this Zoning Code, the Planning and <br />Development Director shall also act in accordance with the requirements of,.Ony other <br />City regulations regarding code enforcement, and shall cooperate with th#`Building <br />Commissioner in the enforcement of the requirements of this ordinance. !F;; <br />3. If the Planning and Development Director shall find any of the provisions of this Code <br />are being violated, he/she shall notify the Building Commissioner'... such violation, <br />B. Enforcement. The duty of enforcing the provisions of the Zoning Code is hereby conferrec <br />upon the Building Commissioner. <br />1. The Building Commissioner, as approved by the Planning and Development Director, <br />may promulgate such rules and regulations as he/she may determine as necessary to <br />supplement or aid in the interpretation of the requirements of the Zoning Code, which <br />regulations shall be consistent therewith and with the rules and regulations of the <br />Building and Zoning Board of Appeals. Rules of the Building Commissioner shall have <br />the same force and effect as provisions of the Zoning'Code and the rules of the Board. <br />2. In addition to any other power given to the Building Commissioner by law or ordinance, <br />the Building Commissioner is empowered and authorized to investigate any reported <br />violation of the provisions of the Zoning Code. The Building Commissioner shall not <br />enter onto any premises for the purposes of conducting any such investigation without <br />first either obtaining the express written consent of the owner or other adult person in <br />control of or in charge of such premises to enter upon the premises to conduct such <br />investigation, or obtaining_a warrant from a court of competent jurisdiction authorizing <br />him/her to conduct a search of the premises. <br />3. The Building Commissioner shall -keep, or cause to be kept, in accordance with <br />applicable records retention requirements, a record of the Division of Building in regard <br />to any decision, determlrâ–ºation or conclusion reached by him/her in connection with the <br />enforcement of the Zoning Code. Such records shall be open to public inspection during <br />regular'ausiness hours.' <br />C. Liability, Neither the Planning and Development Director, the Building Commissioner nor <br />any person appointed or employed by them when acting in good faith and without malice <br />shall be personally liable for damages by reason of anything done under the provisions of <br />the Zoning Code. <br />Section. 1117,02 Schedule of Fees <br />A. City Council shall by resolution establish a schedule of fees, charges and deposits and a <br />collection procedure for zoning compliance reviews, appeals, conditional use permits, <br />variances, development plan reviews, rezoning applications and other matters pertaining to <br />this Code. The schedule of fees shall be available in the Department of Planning and <br />Development and may be amended only by City Council. <br />B. An appropriate fee established by the City Council shall accompany any application. <br />Additionally, a separate deposit may be collected from the applicant, as determined by the <br />Page 1117-1 City of North Olmsted Zoning Code <br />
