Conditional Use Requirements <br />Section 1118.05 Review Procedures <br />A. <br />M <br />1W <br />10 <br />Planning and Development Director Review. The Planning and Development Director <br />shall review the application to determine if all required information has been supplied and <br />will only then forward the complete application and supporting data to the Planning and <br />Design Commission for review and approval. If the application is found to be incomplete, the <br />Planning and Development Director shall provide the applicant a written explanation of any <br />deficiencies. <br />Planning and Design Commission Review. The Planning and Design Commission shall <br />hold a public meeting to review the application and solicit input from the general public and <br />surrounding landowners. Notification shall be provided as required by Chapter 149 of the <br />Codified Ordinances. The Commission shall review the application against the requirements <br />of this ordinance and the review standards for site plans. At the public meeting, the Planning <br />and Design Commission shall make a recommendation to City Council on the application. <br />The Planning and Design Commission shall act on the request within 30 days of receiving <br />the complete application. <br />City Council Action. City Council shall review the application against the Planning and <br />Design Commission's recommendation, the requirements of this ordipance, and the review <br />standards for site plans. City Council shall take one of the following actions on the <br />application: table, deny, approve or approve with conditions. <br />Appeals. The decision of City Council shall be final and may only be reviewed by a Court of <br />Common Pleas, pursuant to the provisions of Chapter 2506 of the Ohio Revised Code. <br />Section 1118.06 General Standards of <br />A. Standards of Approval. City Council shall review the particular circumstances and facts <br />applicable to each proposed conditional use with respect to the following general standards: <br />1. The proposed use is physically and operationally compatible with the surrounding <br />neighborhood and abutting uses. <br />2. The proposed use will not involve uses, activities, processes, materials, equipment and <br />conditions of operations that will be detrimental to any persons, property or the general <br />welfare by reason of excessive production of traffic, noise, smoke, fumes, glare, odor or <br />other characteristic not comparable to the uses permitted in the base zoning district. A <br />use which produces smoke, fumes, glare or odor shall be considered detrimental to <br />other persons or property if it is objectionable to a reasonable person of ordinary <br />sensibilities. <br />3. The use pan be,, accommodated on the site consistent with all applicable design <br />standards and In conformance with all development regulations for the district in which it <br />will be located. <br />4. 'The proposed use will not impede the normal and orderly development and improvement <br />of the surrounding property for uses permitted in the district. <br />5. On-site and off-site traffic generation and circulation patterns shall not adversely impact <br />adjacent uses or result in hazardous conditions for pedestrians or vehicles in or adjacent <br />to the site. <br />6. The use will be adequately served by public facilities and services including, but not <br />limited to, water, sewer, electric, schools, streets, fire and police protection, storm <br />drainage, public transit and public parks/trails. <br />Page 1118-2 City of North Olmsted Zoning Code <br />
