CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2017 - 37 <br />By: Mayor Kennedy <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A <br />COOPERATIVE AGREEMENT WITH THE CITY OF WESTLAKE TO PROVIDE <br />FOR THE IMPROVEMENT OF COLUMBIA ROAD FROM 300' SOUTH OF <br />CARNATION RUN DRIVE, NORTHBOUND TO THE CORPORATION LINE, <br />TOGETHER WITH ADDITIONAL FINANCIAL TERMS AND CONDITIONS, <br />AND DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, the City of North Olmsted and the City of Westlake have jointly recognized <br />the need for and propose a Cooperative Agreement for Columbia Road Improvement; and <br />WHEREAS, the City of Westlake has been awarded funding from Cuyahoga County <br />and/or the State of Ohio for 85% of the street improvement costs and has proposed to pave that <br />portion of Columbia Road within the City of North Olmsted upon agreement to contribute 15% of <br />the costs, estimated to be $18,000.00; and <br />WHEREAS, it is accordingly the desire of this Council, acting upon the recommendation <br />of the Director of Public Safety/Service, to authorize the Mayor to enter into an Agreement with <br />the City of Westlake for the resurfacing of Columbia Road, 300' south of Carnation Run to the <br />City limits; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into a Cooperative <br />Agreement with the City of Westlake to provide for the improvement and resurfacing of Columbia <br />Road, from the area 300' south of Carnation Run Drive, northbound to the City limits, upon such <br />financial terms and conditions as outlined in the Cooperative Agreement. Said Agreement shall <br />be in substantially the same form and substance as the terms and conditions are outlined therein, <br />with only such changes thereto as are not substantially adverse to the City and which are approved <br />by the Director of Law. The character of any such changes as not being substantially adverse to <br />the City shall be evidenced conclusively by the execution of the agreement by the Mayor and the <br />approval of the agreement by the Director of Law. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare; and further <br />provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect <br />and be in force immediately upon its passage and approval by the Mayor. <br />PASSED: /kc' / L, FG� First Reading: �/ <br />
