CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2017 - 45 <br />By: Mayor Kennedy <br />A RESOL UTIONA UTHORIZING THE MA YOR, ONBEHALF OF THE <br />CITY OF NORTH OLMSTED, TO ENTER INTO A LICENSE <br />AGREEMENT WITH NORTHERN VIEW VILLAS, GRANTING <br />PERMISSION TO INSTALL AN IDENTIFICATION SIGN IN THE <br />PUBLIC RIGHT OF WA Y ONBROOKPARKROAD IN THE VICINITY <br />OF COLUMBIA ROAD, AND DECLARING AN EMERGENCY. <br />WHEREAS, the Northern View Villas (formally 4879 Columbia Road Associates, LLC) <br />proposes to replace and install a new identification sign at the corner of Brookpark and Columbia <br />Roads (Southeast corner), at the same location as the existing identification sign located in the right <br />of way; and <br />WHEREAS, the City Engineer has reviewed and recommended approval of the proposed <br />location; and <br />WHEREAS, it is accordingly the desire of this Council to authorize the Mayor to enter into a <br />License Agreement with Northern View Villas in order to allow construction of an identification sign <br />within the City's right of way. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into a License <br />Agreement with 4879 Columbia Road Associates, LLC, dba Northern View Villas. The License <br />Agreement shall be in form and substance substantially similar to the attached License Agreement, <br />marked as Exhibit A, and attached hereto, with only such changes to be hereinafter made in said <br />contract as are not substantially adverse to the City and which are approved by the Director of Law. <br />The character of any such changes as not being substantially adverse to the City shall be evidenced <br />conclusively by the execution of the Agreement by the Mayor and the approval of the Agreement by <br />the Director of Law. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the public health, safety and welfare to expedite replacement of existing <br />sign delayed by unnecessary application of Board of Zoning and Building Appeals; and further <br />provided it receives the affirmative vote of two thirds of the members of Council, it shall take effect <br />upon its approval by the Mayor. <br />PASSED: J) (l�- First Reading: - % <br />Second Reading: �55p, <br />Third Reading:✓SP <br />Committee: <br />ATTEST: <br />
