CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2017 - 70 <br />By: Mayor Kennedy <br />AN ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC SAFETY <br />TO PURCHASE AN EMERGENCY MEDICAL VEHICLE FOR THE <br />NORTH OLMSTED FIRE DEPARTMENT FROM HORTON EMV AT A <br />COST OF $342,098.00, AS PRICED THROUGH THE STATE PURCHASING <br />PROGRAM, FURTHER AUTHORIZING THE MAYOR TO EXECUTE <br />NECESSARY CONTRACT DOCUMENTS, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Director of Public Safety, with the support of the Fire Chief, has <br />recommended to the Mayor and Council that the City of North Olmsted purchase a Horton <br />Emergency Medical Vehicle (EMV) to be deployed by its Fire Department for public safety; and <br />WHEREAS, the EMV will assist the Fire Department to protect the health, safety and <br />general welfare of North Olmsted residents and other citizens because this new and better <br />equipment will enhance the continued safety of citizens and fire fighters during emergency <br />medical responses; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to purchase the Horton <br />EMV through the State Purchase Program for use by the Fire Department, as a permitted <br />exception to the competitive bidding procedure that otherwise would be required for such <br />expenditure, and to further authorize the Mayor to execute any necessary contract documents. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to purchase through the <br />State Purchasing Program, which was established by O.R.C. Section 125.04, and which the City <br />is authorized to participate in pursuant to Charter, one (1) new Emergency Medical Vehicle, <br />described as a Horton 623 Type 1, from the Horton EMV Company, based on STS pricing of <br />$342,098.00, as is described in the specifications on file in the Fire Department and the Horton <br />proposal dated September 15, 2017. If necessary to effectuate any such purchase through the <br />State Purchasing Program, the Mayor is hereby authorized to execute any contract and/or other <br />appropriate documents required by the authorized vendor(s) or the State of Ohio. Any such <br />contract(s) executed by the Mayor shall be in a form and substance consistent with the provisions <br />of this Ordinance and approved by the Director of Law. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to place the order for EMV now due to a 180 day <br />lead time for orders, and to enhance public safety at the earliest possible date, and further <br />
