CITY OF NORTH OLMSTED ORDINANCE NO. 2017 - 70 By: Mayor Kennedy AN ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC SAFETY TO PURCHASE AN EMERGENCY MEDICAL VEHICLE FOR THE NORTH OLMSTED FIRE DEPARTMENT FROM HORTON EMV AT A COST OF $342,098.00, AS PRICED THROUGH THE STATE PURCHASING PROGRAM, FURTHER AUTHORIZING THE MAYOR TO EXECUTE NECESSARY CONTRACT DOCUMENTS, AND DECLARING AN EMERGENCY. WHEREAS, the Director of Public Safety, with the support of the Fire Chief, has recommended to the Mayor and Council that the City of North Olmsted purchase a Horton Emergency Medical Vehicle (EMV) to be deployed by its Fire Department for public safety; and WHEREAS, the EMV will assist the Fire Department to protect the health, safety and general welfare of North Olmsted residents and other citizens because this new and better equipment will enhance the continued safety of citizens and fire fighters during emergency medical responses; and WHEREAS, it is the desire of this Council to authorize the Mayor to purchase the Horton EMV through the State Purchase Program for use by the Fire Department, as a permitted exception to the competitive bidding procedure that otherwise would be required for such expenditure, and to further authorize the Mayor to execute any necessary contract documents. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized to purchase through the State Purchasing Program, which was established by O.R.C. Section 125.04, and which the City is authorized to participate in pursuant to Charter, one (1) new Emergency Medical Vehicle, described as a Horton 623 Type 1, from the Horton EMV Company, based on STS pricing of $342,098.00, as is described in the specifications on file in the Fire Department and the Horton proposal dated September 15, 2017. If necessary to effectuate any such purchase through the State Purchasing Program, the Mayor is hereby authorized to execute any contract and/or other appropriate documents required by the authorized vendor(s) or the State of Ohio. Any such contract(s) executed by the Mayor shall be in a form and substance consistent with the provisions of this Ordinance and approved by the Director of Law. SECTION 2: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that it is immediately necessary to place the order for EMV now due to a 180 day lead time for orders, and to enhance public safety at the earliest possible date, and further
