assigned to light duty are not considered to be <br />permanently assigned to a forty (40) hour work <br />week. <br />State Employment Relations Board: The State Employment Relations Board of the State <br />of Ohio. <br />Treasurer: The individual occupying the position of Treasurer <br />of the Association from time to time. <br />Week Sunday through Saturday <br />ARTICLE III RECOGNITION <br />3.1 The Employer hereby recognizes the Association as the sole and exclusive bargaining <br />unit with respect to wages, hours, and other terms and conditions of employment for all full-time <br />employees in the Fire Department occupying the positions of Fire Fighter, Lieutenant and <br />Captain. All other employees of the Employer are excluded from the bargaining unit. <br />ARTICLE IV <br />MANAGEMENT'S RIGHTS <br />4.1 All matters pertaining to wages, hours, or terms and other conditions of employment and <br />the continuation, modification, or deletion of an existing provision of a collective bargaining <br />agreement are subject to collective bargaining between the public Employer and the exclusive <br />representative, except as otherwise specified. <br />4.2 The conduct and grading of civil service examinations, the rating of candidates, the <br />establishment of eligible lists from the examinations, and the original appointments from the <br />eligible lists are not appropriate subjects for collective bargaining. <br />4.3 Unless a public Employer agrees otherwise in a collective bargaining agreement, nothing <br />in Chapter 4117 of the Revised Code impairs the right and responsibility of each public <br />Employer to: <br />A. Determine matters of inherent managerial policy which include, but are not <br />limited to areas of discretion or policy such as the functions and programs of the <br />public Employer, standards of services, its overall budget, utilization of <br />technology, and organizational structure; <br />B. Direct, supervise, evaluate and hire employees; <br />C. Maintain and improve the efficiency and effectiveness of governmental <br />operations; <br />D. Determine the overall methods, process, means, or personnel by which <br />governmental operations are to be conducted; <br />
