CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2017 - 68 <br />By: Mayor Kennedy and Councilman Rahm <br />AN ORDINANCE ESTABLISHING A SIDEWALK MAINTENANCE FUND, <br />AFTER APPROVAL FROM THE AUDITOR OF STATE, AS A NON -MAJOR <br />SPECIAL REVENUE FUND TO ACCOUNT FOR THE RECEIPT OF <br />FUNDS COLLECTED FOR SIDEWALK PANEL REPLACEMENT AND <br />RELATED EXPENDITURES. <br />WHEREAS, Ohio Revised Code Section 5705.09(F) requires the City to establish a <br />special fund for each class of revenues derived from a source other than general property tax, <br />which the law requires to be used for a particular purpose; and <br />WHEREAS, the City may receive funds to be used in replacing and / or repairing <br />sidewalk panels throughout the City as identified through the City's Sidewalk Inspection <br />Program; and <br />WHEREAS, it is the desire of the Mayor and Council to establish a Sidewalk <br />Maintenance Fund as a special revenue fund in accordance with law. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That there is hereby established a separate Sidewalk Maintenance Fund, as <br />a Special Revenue Fund, for the purpose of separating the receipt and deposit of specified <br />sidewalk maintenance costs, as may be assessed and paid to the City of North Olmsted. The <br />Director of Finance is authorized and directed to establish such fund and to request approval of <br />such Sidewalk Maintenance Fund by the Auditor of State. Such special revenue fund shall <br />thereafter remain under the control and supervision of the Director of Finance, who shall impose <br />and maintain all financial controls required by law, and provide for audit of such funds in <br />accordance with local and state law; and <br />SECTION 2: That the Sidewalk Maintenance Fund be and remain for an indefinite term, <br />unless otherwise terminated by Council, and further that the Director of Finance be and she is <br />hereby authorized and directed to pay out of said Special Revenue Fund such amounts necessary <br />to meet the costs of maintaining sidewalks in accordance with law; and <br />SECTION 3: That this Ordinance shall take effect and be in force from and after the <br />earliest date provided for by law. <br />PASSED: JVC, E*m6 ( �5 ?1/� First Reading: <br />Second Reading: 10'17-1 <br />Third Reading: 1)-6-1-7 <br />
