CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2017 - 83 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING VARIOUS SECTIONS OF CHAPTER 911 <br />ENTITLED "SEWERS GENERALLY," CHAPTER 915 ENTITLED "USER <br />CHARGE SYSTEM," AND CHAPTER 917 ENTITLED "INDUSTRIAL <br />PRETREATMENT" ALL OF THE STREETS, UTILITIES AND PUBLIC <br />SERVICES CODE IN ORDER TO COMPLY WITH EPA REGULATIONS, <br />AND DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, the Ohio Environmental Protection Agency, in the course of its routine <br />review of rules and regulations for operating systems at the North Olmsted Wastewater <br />Treatment Plant, recommended amendment of North Olmsted Codified Chapters 911, 915 and <br />917; and <br />WHEREAS, it is the recommendation of the Administration that the City accept the <br />recommendation of the Ohio EPA and amend Chapters 911, 915 and 917; and <br />WHEREAS, it is the desire of this Council, consistent with the recommendations of the <br />Administration and regulatory authorities, to amend said sections. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Chapters 911, 915 and 917 which presently read in their entirety as <br />set forth in Exhibit A, which is attached to this Ordinance and incorporated by reference as if <br />fully rewritten herein, shall be amended and, as amended, shall read in their entirety as set forth <br />in Exhibit A, as such amendments are noted by highlighted additions and strikethrough deletions. <br />SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with <br />this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or <br />inconsistent provisions of any Ordinance shall be corrected at re -codification. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, health, safety and welfare of this <br />City, and for the further reason that this Ordinance is required to be immediately effective in <br />order to come into compliance with Environmental Protection Agency requirements; and further <br />provided that it receives the affirmative vote of two-thirds of all members of Council, it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor. <br />PASSED: �,�'�'�M � r"( f� First Reading: 11-2-1-17 <br />Second Reading: 12 -5—/72 <br />Third Reading: 12-11-1-7 <br />
