ARTICLE 4: <br />DUES DEDUCTION AND FAIR SHARE <br />SECTION 1: The Employer agrees that it shall deduct the initiation fee, assessments and <br />regular monthly dues from the pay of regular full-time employees covered by this Agreement <br />upon receipt from the OPBA of individual written authorization cards which have been <br />voluntarily executed by the employee for that purpose and bearing the employees signature. <br />SECTION 2: Deductions of assessments, dues and fees shall be made during the first pay <br />period of each month and if an employee's pay for that period is insufficient to cover OPBA <br />assessments or dues, the Employer will make a deduction from the pay earned in the next period <br />or subsequent period. All deductions for assessments or dues shall be accompanied by an <br />alphabetical list of all employees for whom the deductions have been made and shall be <br />transmitted to the OPBA no later than thirty (30) days following the end of the pay period in <br />which the deductions are made. Upon receipt, the OPBA shall assume full responsibility for the <br />disposition of all funds deducted. <br />SECTION 3: The OPBA shall indemnify and save the Employer harmless from any and all <br />liabilities or damages which may arise from the performance of its obligations under the <br />provisions of this Article and the OPBA shall indemnify the Employer for any such liability or <br />damages that may arise from any action growing out of deductions, commenced by an employee <br />against the Employer or the Employer and the OPBA jointly. <br />SECTION 4: All full-time bargaining unit employees who are not members of the OPBA shall <br />pay a fair share fee to the OPBA in the amount certified by the OPBA as being properly <br />chargeable as a fair share fee. Employees who have received a Religious Exemption from the <br />State Employment Relations Board are exempt from having dues, assessments and/or a fair share <br />fee deducted from their pay check(s). All full-time employees who voluntarily choose not to <br />become dues paying members of the OPBA shall pay the fair share fee, effective sixty (60) days <br />from the employees date of hire. The deduction of the fair share fee shall be automatic and does <br />not require a written authorization for a payroll deduction. Payment to the Association of fair <br />share fees shall be made in accordance with the procedure contained within Section 2, above. <br />SECTION 5: In the event that a service fee is to be charged to a dues paying member of the <br />OPBA, the Employer shall deduct such fee in the same manner as dues are deducted as specified <br />in Section 2, above. <br />ARTICLE 5: <br />NON-DISCRIMINATION <br />SECTION 1: Both the Employer and the OPBA recognize their respective responsibilities <br />under the Federal and State Civil Right Laws, Fair Employment Practices Act, and other similar <br />2 <br />
