CITY OF NORTH OLMSTED ORDINANCE NO. 2018 - 5 BY: Mayor Kennedy AN ORDINANCE AMENDING CHAPTER 721 OF THE BUSINESS REGULATION CODE, ENTITLED "PEDDLERS, SOLICITORS AND TEMPORARY BUSINESSES," IN ORDER TO PROHIBIT TRANSIENT VENDORS AND THE LICENSING OF TEMPORARY PLACES OF BUSINESS. WHEREAS, the regulation of land use and commercial development is governed generally by the City's Planning and Zoning Code, Part Eleven of the Codified Ordinances, which includes several standards for the issuance of permits for permanent retail establishments; and WHEREAS, additional temporary business activities are regulated and permitted by the Business Regulation Code, Chapter 733, Tent Sales and Special Events; and WHEREAS, it is the desire of this Council to enact amendments to Chapter 721 to prohibit transient vendors and the licensing of temporary places of business by the repeal of Sections 721.01 (c) and (d), 721.04, 721.05, 721.06 and 721.09 (a) in order to preserve and protect the health, safety and general welfare of the residents of the City of North Olmsted, consistent with City's regulation of land use and zoning laws.; and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OFNORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Chapter 721 "Peddlers, Solicitors and Temporary Businesses" which presently reads in its entirety as set forth in Exhibit A, which is attached to this Ordinance and incorporated by reference as if fully rewritten herein, shall be amended and, as amended, shall read in its entirety as set forth in Exhibit B, which is likewise attached to this Ordinance and likewise incorporated by reference as if fully rewritten herein. SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or inconsistent provisions of any Ordinance shall be corrected at re - codification.
