CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2018 - 5 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING CHAPTER 721 OF THE BUSINESS <br />REGULATION CODE, ENTITLED "PEDDLERS, SOLICITORS AND <br />TEMPORARY BUSINESSES," IN ORDER TO PROHIBIT <br />TRANSIENT VENDORS AND THE LICENSING OF TEMPORARY <br />PLACES OF BUSINESS. <br />WHEREAS, the regulation of land use and commercial development is governed <br />generally by the City's Planning and Zoning Code, Part Eleven of the Codified <br />Ordinances, which includes several standards for the issuance of permits for permanent <br />retail establishments; and <br />WHEREAS, additional temporary business activities are regulated and permitted <br />by the Business Regulation Code, Chapter 733, Tent Sales and Special Events; and <br />WHEREAS, it is the desire of this Council to enact amendments to Chapter 721 <br />to prohibit transient vendors and the licensing of temporary places of business by the <br />repeal of Sections 721.01 (c) and (d), 721.04, 721.05, 721.06 and 721.09 (a) in order to <br />preserve and protect the health, safety and general welfare of the residents of the City of <br />North Olmsted, consistent with City's regulation of land use and zoning laws.; and <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OFNORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 721 "Peddlers, Solicitors and Temporary Businesses" <br />which presently reads in its entirety as set forth in Exhibit A, which is attached to this <br />Ordinance and incorporated by reference as if fully rewritten herein, shall be amended <br />and, as amended, shall read in its entirety as set forth in Exhibit B, which is likewise <br />attached to this Ordinance and likewise incorporated by reference as if fully rewritten <br />herein. <br />SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent <br />with this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. <br />Conflicting or inconsistent provisions of any Ordinance shall be corrected at re - <br />codification. <br />SECTION 3: That this Ordinance shall take effect and be in force from and after <br />the earliest date provided for by law.. <br />PASSED: �C�k� s �; / I �b First Reading: ` ( 6 _ k� <br />-� Second Reading: Z-,' ? <br />
