CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2018 - 13 <br />BY: Mayor Kennedy and Councilman Glassburn <br />A RESOLUTION AUTHORIZING THE DIRECTOR OF PLANNING <br />& DEVELOPMENT TO SOLICIT PROPOSALS FOR A CONTRACT <br />TO DEMOLISH AND REMOVE A DANGEROUS BUILDING <br />LOCATED AT 4033 WALTER ROAD, AS A PUBLIC NUISANCE; <br />AND FURTHER AUTHORIZING THE DEMOLITION COSTS TO BE <br />CERTIFIED AS A TAX LIEN PURSUANT TO OHIO REVISED <br />CODE SECTION 715.261 AND SECTION 1363.108.7 OF THE <br />CODIFIED ORDINANCES, AND DECLARING AN EMERGENCY. <br />WHEREAS, the Building Commissioner has determined that the house with <br />attached garage, located at 4033 Walter Road, North Olmsted, OH 44070, is both <br />dangerous and constitutes a public nuisance, as defined by NOCO §1363.108 and <br />1364.107 and, due to the extensive deterioration of this abandoned structure, has issued <br />an Order dated December 28, 2017, to abate the public nuisance by demolition and <br />removal of the unsafe structure; and <br />WHEREAS, the Building Commissioner and Law Department have, in <br />accordance with NOCO §1363.108.2 and 1364.107.1, issued notification to the property <br />owner, lienholders or others having an interest in said property as to the determination of <br />dangerous buildings, existence of nuisance conditions and Order of abatement by <br />demolition; and <br />WHEREAS, although notified in accordance with law, and otherwise prosecuted <br />for property maintenance violations, the property owner, lienholders and others having an <br />interest in the property have failed to comply with said repair/demolition Order and have <br />failed to appeal from the said administrative determination of the Building <br />Commissioner; and <br />WHEREAS, it is the desire of this Council, in accordance with NOCO § <br />1363.108 and 1364.107, to cause the dangerous building located at 4033 Walter Road in <br />the City of North Olmsted to be demolished and removed in order to abate the public <br />nuisance arising therefrom and to further cause the costs of demolition and removal to be <br />certified and placed upon the tax duplicate as a lien upon the property; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Planning and Development be and she is <br />hereby authorized to proceed with, arrange for, and initiate all reasonable measures, <br />either directly or through the Building Commissioner, to solicit proposals from <br />contractors to enter into an agreement to perform demolition and removal of all <br />
