CITY OF NORTH OLMSTED RESOLUTION NO. 2018 - 16 BY: Mayor Kennedy A RESOLUTION DECLARING THE NECESSITY OF THE CONSTRUCTION AND REPAIR OF CERTAIN SIDEWALKS IN THE CITY OF NORTH OLMSTED BY THE ABUTTING PROPERTY OWNERS, THE CONSTRUCTION, REPAIR, AND ASSESSMENT OF THE COSTS OF SIDEWALKS IN CERTAIN CASES BY THE CITY, AND DECLARING AN EMERGENCY. WHEREAS, the City of North Olmsted City Council desires to establish a sidewalk repair program in the City of North Olmsted; and WHEREAS, the Ohio Revised Code (Chapter 729) and North Olmsted Charter authorize the City to require Owners to construct and repair sidewalks abutting their property; and WHEREAS, if the abutting property owner does not perform the necessary construction and repairs, the City may make the necessary repairs and assess on the property owners tax duplicate such construction and repair costs; and NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That this Council hereby deems it necessary to require the construction or repair of sidewalks, curbs, or gutters within the municipal corporation by the owners of the lots or lands abutting thereon as identified on the attached Exhibit A, a copy of which is attached hereto, made a part hereof, and incorporated herein as though fully rewritten. SECTION 2: That Council accepts and approves the plans, specifications, and estimate of cost for the proposed construction and repair of the sidewalks as are on file in the Office of the Clerk of Council located at 5200 Dover Center Road, North Olmsted, Ohio 44070. SECTION 3: This Council accepts and approves of the list of lots and lands abutting upon the sidewalks to be constructed or repaired as described by street address and further identified on Exhibit A which is attached hereto, made a part hereof and incorporated herein as though fully rewritten. SECTION 4: That the owners of said described lots and lands abutting such sidewalks, are identified on attached Exhibit A, shall construct and repair the sidewalks in accordance with the plans and specifications on file in the Office of the Clerk of Council. SECTION 5: That the owners of said described lots and lands abutting such sidewalks as identified on attached Exhibit A, shall construct and repair the sidewalks abutting their lots and lands on or before June 15, 2018.
