The log shall be made available to the City of North Olmsted upon <br />request, during regular business hours. A masseur or masseuse shall not provide any <br />massage to a person seeking a massage at a massage establishment if that person fails or <br />refuses, for any reason, to present the photo identification required herein. <br />(8) No massage establishment shall be or remain open for business, operate or <br />provide massages at any time between 12:00 midnight and 6:00 a.m. on any day. No <br />person shall allow a massage establishment to be open or to remain open for business, to <br />operate or to provide massages at any time between 12:00 midnight and 6:00 a.m. on any <br />day. <br />(Ord. 2014-99. Passed 1-6-15.) <br />BE AMENDED AND, AS AMENDED, SHALL READ AS FOLLOWS: <br />749.09 DISPLAY OF PERMIT OR LICENSE; INSPECTIONS; CLIENT <br />IDENTIFICATION AND RECORD. <br />(a) Each massage establishment permit holder shall display at all times, and in a <br />conspicuous place open to the public within the massage establishment, his/her/its current <br />permit so that the same may be readily seen by persons upon entering the premises. <br />(b) Each masseur or masseuse shall display at all times, and in a conspicuous <br />place open to the public within the massage establishment, his or her current license so <br />that the same may be readily seen by persons upon entering the premises. <br />(c) The Director of Public Safety, or his/her representatives, shall, from time to <br />time, make an inspection of each massage establishment granted a permit for the purpose <br />of determining that the provisions of this chapter and other applicable laws and <br />regulations are being complied with. The Chief of Police of the City of North Olmsted or <br />his / her representatives, may, from time to time and in addition to the inspections <br />provided for in the preceding sentence, make an inspection of each massage <br />establishment granted a permit for the purpose of determining that the provisions of this <br />chapter and other applicable laws and regulations are being complied with. Such <br />inspections shall be made at reasonable times and in a reasonable manner, during regular <br />business hours. Ne per -mit holder- shall fail to allow sueh sue ; tion offieeror- fflei,1 <br />aeeess to the premises ..1 rodef sueh e ffiee,. of offiei l In the event that <br />a permit holder refuses to consent to such inspection and denies access to the <br />premises and/or records, then the public or police officials requesting such <br />inspection shall document the permit holders' refusal and denial in writing, and <br />request the advice of the Director of Law, or designated legal counsel, to acquire an <br />administrative search warrant. <br />(d) Other operating requirements. <br />(1) Every portion of a massage establishment, including appliances and <br />apparatus, shall be kept clean and operated in a sanitary condition at all times. <br />(2) All massage establishments shall be provided at all times with clean, <br />laundered sheets and towels in sufficient quantity, and the sheets and towels shall be <br />laundered after each use thereof and stored in a sanitary manner. <br />
