CITY OF NORTH OLMSTED RESOLUTION NO. 2018 - 63 By: Mayor Kennedy A RESOLUTION RATIFYING AND FURTHER AUTHORIZING THE MAYOR TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT FOR SHARED SERVICES I MATERIALS WITH THE CITY OF NORTH RIDGEVILLE AND DECLARING ANEMERGENCY. WHEREAS, a need has been identified by the North Olmsted Service Department to enter into a formal agreement with the City of North Ridgeville for the acquisition and application of certain street repair materials; and WHEREAS, the City of North Olmsted entered into a contract October 25, 2017 for the purchase of emulsion materials from the City of North Ridgeville, at cost, plus ten percent (10%); and WHEREAS, Section 9.482 of the Ohio Revised Code, as enacted pursuant to H.B. 153 (the State Budget Bill), permits a political subdivision to enter into agreements with other political subdivisions under which a contracting political subdivision agrees to exercise any power, perform any function or render any service for another contracting recipient subdivision that the contracting recipient political subdivision is otherwise legally authorized to exercise, perform or render, subject to the approval of their respective legislative authorities; and WHEREAS, the Parties acknowledge that in the spirit of intergovernmental cooperation, a regional approach to the provision of certain services / goods will be considered when the means for such cooperative effort are available and result in a cost savings and/or enhanced delivery of public services; and WHEREAS, the City of North Ridgeville ("Provider") has the means to store and sell emulsion materials to willing Municipal Agencies, as set forth in Exhibit A attached hereto and made a part thereof as though fully written herein; and WHEREAS, North Olmsted has identified a need to contract for such services / goods; and WHEREAS, the City of North Olmsted is ready, willing and able to contract with North Ridgeville on the terms and conditions hereinafter set forth, to provide materials and / or services for the City of North Olmsted in accordance with the agreement in Exhibit A. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO:
