CITY OF NORTH OLMSTED, OHIO ORDINANCE NO. 2018 - 75 BY: Mayor Kennedy AN ORDINANCE AMENDING CHAPTER 904 (ENTITLED "SMALL CELL FACILITIES AND WIRELESS SUPPORT STRUCTURES WITHIN THE RIGHT-OF-WAY'), OF THE STREETS AND PUBLIC SERVICES CODE, AND DECLARING AN EMERGENCY. WHEREAS, this Council, by and through Ordinance No. 2018-57, recently adopted and established new regulations for the use of the Public Right -of -Way through new Chapter 904 entitled "Small Cell Facilities and Wireless Support Structures within the Right of Way" within Part Nine, "Streets, Utilities and Public Services Code", of the Codified Ordinances of the City; and WHEREAS, the Directors of Law and Planning, with consultation by the City Engineer, recommend further minor changes to facilitate implementation of the permit process, prior to the anticipated arrival of permit application pursuant to Ohio Substitute House Bill 478, effective July 31, 2018; WHEREAS, this Council Ordinance intends to adopt these further amendments to Chapter 904 as an emergency measure for the immediate preservation of the public peace, property, health, safety, or general welfare, in harmony with state law, including HB 478, prior to the receipt of additional small cell permit applications. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That Chapter 904, "Small Cell Facilities and Wireless Support Structures within the Right -of -Way" of Part Nine, "Streets, Utilities and Public Services Code" of the Codified Ordinances of the City of North Olmsted, be and is hereby amended as set forth in the attached Exhibit A, which is fully incorporated by reference herein. SECTION 2: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the public health, safety and welfare in order that the City may immediately exercise control over its Right -of -Way, not in conflict with state law; and further provided it receives the affirmative vote of two thirds of the members of Council, it shall take effect upon its approval by the Mayor.
