CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2018 - 104 <br />BY: Mayor Kennedy <br />A RESOLUTION DISPENSING WITH THE RFP PROCESS AND <br />AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT <br />WITH CT CONSULTANTS, INC. FOR ENGINEERING SERVICES <br />FOR HVAC SYSTEMS AT THE DOVER, LEBERN & CLAGUE <br />PARK LIFT STATIONS OF THE SANITARY SEWER COLLECTION <br />SYSTEM, AND DECLARING AN EMERGENCY. <br />WHEREAS, CT Consultants, Inc. has provided professional services to the City of <br />North Olmsted concerning the maintenance and operation of the sanitary sewer collection <br />system; and <br />WHEREAS, the City has been satisfied by the professional services provided by CT <br />Consultants, Inc.; and <br />WHEREAS, with its historical knowledge, CT Consultants, Inc. is uniquely qualified <br />to provide required analysis of the HVAC operations at the Dover, Lebern and Clague Park <br />Lift Stations at a cost not to exceed $24,600.00; and <br />WHEREAS, Section 112.10(c) of the Administrative Code provides that as an <br />exception to the RFP process, the City, upon approval of the Council, need not conduct a <br />formal RFP if the services sought are of such a unique or specialized nature that conducting <br />additional process will not likely result in obtaining more qualified proposals; and <br />WHEREAS, it is accordingly the desire of this Council, in light of the continuing <br />professional relationship, as well as the unique or specialized nature of the knowledge <br />possessed by CT Consultants, Inc., to authorize the Mayor to enter into an agreement with CT <br />Consultants, Inc. for the purpose of providing professional services as described. <br />NOW, THEREFORE, BE IT RESOL VED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the formal RFP process required by Chapter 112 of the <br />Administrative Code is hereby dispensed with by reason of the continuing professional <br />relationship between the City of North Olmsted and CT Consultants, Inc., and the Mayor be <br />and he hereby is authorized to enter into an Agreement for professional services to be <br />provided by CT Consultants, Inc. The Agreement shall be in form and substance substantially <br />similar to the Agreement, marked as Exhibit A and attached hereto, with only such changes to <br />be hereinafter made in said contract as are not substantially adverse to the City and which are <br />approved by the Director of Law. The character of any such changes as not being <br />substantially adverse to the City shall be evidenced conclusively by the execution of the <br />Agreement by the Mayor and the approval of the Agreement by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, health, safety and welfare of <br />
