CITY OF NORTH OLMSTED RESOLUTION NO. 2018 - 104 BY: Mayor Kennedy A RESOLUTION DISPENSING WITH THE RFP PROCESS AND AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH CT CONSULTANTS, INC. FOR ENGINEERING SERVICES FOR HVAC SYSTEMS AT THE DOVER, LEBERN & CLAGUE PARK LIFT STATIONS OF THE SANITARY SEWER COLLECTION SYSTEM, AND DECLARING AN EMERGENCY. WHEREAS, CT Consultants, Inc. has provided professional services to the City of North Olmsted concerning the maintenance and operation of the sanitary sewer collection system; and WHEREAS, the City has been satisfied by the professional services provided by CT Consultants, Inc.; and WHEREAS, with its historical knowledge, CT Consultants, Inc. is uniquely qualified to provide required analysis of the HVAC operations at the Dover, Lebern and Clague Park Lift Stations at a cost not to exceed $24,600.00; and WHEREAS, Section 112.10(c) of the Administrative Code provides that as an exception to the RFP process, the City, upon approval of the Council, need not conduct a formal RFP if the services sought are of such a unique or specialized nature that conducting additional process will not likely result in obtaining more qualified proposals; and WHEREAS, it is accordingly the desire of this Council, in light of the continuing professional relationship, as well as the unique or specialized nature of the knowledge possessed by CT Consultants, Inc., to authorize the Mayor to enter into an agreement with CT Consultants, Inc. for the purpose of providing professional services as described. NOW, THEREFORE, BE IT RESOL VED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the formal RFP process required by Chapter 112 of the Administrative Code is hereby dispensed with by reason of the continuing professional relationship between the City of North Olmsted and CT Consultants, Inc., and the Mayor be and he hereby is authorized to enter into an Agreement for professional services to be provided by CT Consultants, Inc. The Agreement shall be in form and substance substantially similar to the Agreement, marked as Exhibit A and attached hereto, with only such changes to be hereinafter made in said contract as are not substantially adverse to the City and which are approved by the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the Agreement by the Mayor and the approval of the Agreement by the Director of Law.
