165.08 ADMINISTRATIVE CODE 70D <br />(1) Alteration or reconstruction of, or addition to, the exterior of any <br />improvement which constitutes all or part of a designated Landmark; <br />(2) Demolition of any improvement which constitutes all or part of a <br />designated Landmark; <br />(3) Alteration or reconstruction of, or addition to, the exterior of any <br />improvement which constitutes all or part of a building or structure <br />which has not been designated as a landmark, but is located in a <br />Landmark District; <br />(4) Demolition of any improvement which constitutes all or part of a <br />building or structure which has not been designated as a landmark, but is <br />located in a Landmark District; <br />(5) Construction or erection of, or addition to, any improvement, which has <br />not been designated as a landmark, but is located upon any land in a <br />Landmark District. <br />(b) No building permit for any of the activities set forth in subsection (a) above shall <br />be issued except as provided otherwise in this chapter, or unless it is accompanied by a <br />Certificate of Appropriateness issued by the Landmarks Commission. The Building <br />Commissioner shall, within seven (7) days, after receiving an application for a building permit <br />which seeks authorization for any of the foregoing activities, transmit to the Commission a <br />copy of the application for the building permit, accompanied by such documents as the <br />Building Commissioner and/or the Commission by rule shall require. <br />(Ord. 99-40. Passed 5-5-99.) <br />165.08 REVIEW PROCESS FOR ALTERATIONS, ETC., TO LANDMARKS. <br />(a) Approval of Acceptable Proposed Work for Landmarks. <br />(1) Upon the request of any affected property owner, the Commission may <br />review any proposal for constructing, reconstructing, erecting, adding to, <br />demolishing, or otherwise altering any Landmark as set forth in Section <br />165.07(a)(1) or (a)(2), prior to receiving an application for a building <br />permit for such alterations from the Building Commissioner. If the <br />Commission finds that the proposed work is of a nature which will not <br />adversely affect or destroy any exterior architectural feature of the <br />Landmark and is appropriate or consistent with the spirit and purposes of <br />this chapter, it shall issue a Certificate of Appropriateness and this <br />Certificate shall be sufficient for the applicant of a building permit to <br />meet the requirements of subsection (b) of Section 165.07, and the <br />Building Commissioner shall proceed with the review of any application <br />filed within one year thereafter by the applicant in accordance with all <br />other applicable laws of the City. <br />July 2018 Replacement <br />
