165.08 ADMINISTRATIVE CODE 70D (1) Alteration or reconstruction of, or addition to, the exterior of any improvement which constitutes all or part of a designated Landmark; (2) Demolition of any improvement which constitutes all or part of a designated Landmark; (3) Alteration or reconstruction of, or addition to, the exterior of any improvement which constitutes all or part of a building or structure which has not been designated as a landmark, but is located in a Landmark District; (4) Demolition of any improvement which constitutes all or part of a building or structure which has not been designated as a landmark, but is located in a Landmark District; (5) Construction or erection of, or addition to, any improvement, which has not been designated as a landmark, but is located upon any land in a Landmark District. (b) No building permit for any of the activities set forth in subsection (a) above shall be issued except as provided otherwise in this chapter, or unless it is accompanied by a Certificate of Appropriateness issued by the Landmarks Commission. The Building Commissioner shall, within seven (7) days, after receiving an application for a building permit which seeks authorization for any of the foregoing activities, transmit to the Commission a copy of the application for the building permit, accompanied by such documents as the Building Commissioner and/or the Commission by rule shall require. (Ord. 99-40. Passed 5-5-99.) 165.08 REVIEW PROCESS FOR ALTERATIONS, ETC., TO LANDMARKS. (a) Approval of Acceptable Proposed Work for Landmarks. (1) Upon the request of any affected property owner, the Commission may review any proposal for constructing, reconstructing, erecting, adding to, demolishing, or otherwise altering any Landmark as set forth in Section 165.07(a)(1) or (a)(2), prior to receiving an application for a building permit for such alterations from the Building Commissioner. If the Commission finds that the proposed work is of a nature which will not adversely affect or destroy any exterior architectural feature of the Landmark and is appropriate or consistent with the spirit and purposes of this chapter, it shall issue a Certificate of Appropriateness and this Certificate shall be sufficient for the applicant of a building permit to meet the requirements of subsection (b) of Section 165.07, and the Building Commissioner shall proceed with the review of any application filed within one year thereafter by the applicant in accordance with all other applicable laws of the City.
