165.12 ADMINISTRATIVE CODE 70L <br />(c) Demolition Guidelines. The Commission shall review all applications to <br />demolish or move buildings or structures for the effects of the proposed action on the <br />Landmarks District and the City generally. <br />(1) If the Commission finds the proposed action will have no detrimental <br />effect on the continued historic architectural character of the area and is <br />in keeping with the intent and purposes of this chapter, the application <br />shall be approved. <br />(2) If the Commission finds demolition or removal will have detrimental <br />effects on the Landmarks District or upon the City in general, approval <br />may not be given for a period of up to six (6) months. During this <br />period, the Commission shall review the following: <br />A. Alternative uses for the building or structure; <br />B. Condition of the building; <br />C. Potential return on investment by rehabilitation and use of the <br />building on the existing site; <br />D. Efforts by owners to secure profitable new owners or lessees for <br />the building; and <br />E. Impact of demolition or removal on adjoining structures and the <br />integrity of the area as a whole, including proposed new <br />structures on the vacated site. <br />(3) At the end of the six (6) month period, or any extension mutually agreed <br />upon by the City and the owner, the City of North Olmsted or any other <br />public or private body shall either make a bona -fide purchase or lease <br />offer for the building or structure, or the application for the demolition <br />or moving shall be recommended for approval by the Commission as <br />provided for in Section 165.07 of this chapter. <br />(Ord. 99-40. Passed 5-5-99.) <br />165.12 PROHIBITED MATERIALS. <br />In the construction, reconstruction, restoration or other alteration of any Landmark, or <br />other building or structure located within a Landmark District, the following materials shall not <br />be used: <br />(a) Neon lighting; <br />(b) Dryvit or E.I.F.S. <br />(Ord. 99-40. Passed 5-5-99.) <br />165.13 EXEMPTED BUILDING ACTIVITIES. <br />The provisions of this chapter shall not apply to: <br />(a) The construction or placement of swimming pools on residential property; <br />(b) The construction or placement of fences (other than chain-link fences) on <br />residential property; <br />(c) The construction or placement of satellite dishes with diameters less than thirty- <br />nine inches (except upon Landmarks); <br />(d) Any activity which consists of or only constitutes a repair, maintenance, or <br />identical material replacement of a component of any building or other structure. <br />(Ord. 99-40.
