165.12 ADMINISTRATIVE CODE 70L (c) Demolition Guidelines. The Commission shall review all applications to demolish or move buildings or structures for the effects of the proposed action on the Landmarks District and the City generally. (1) If the Commission finds the proposed action will have no detrimental effect on the continued historic architectural character of the area and is in keeping with the intent and purposes of this chapter, the application shall be approved. (2) If the Commission finds demolition or removal will have detrimental effects on the Landmarks District or upon the City in general, approval may not be given for a period of up to six (6) months. During this period, the Commission shall review the following: A. Alternative uses for the building or structure; B. Condition of the building; C. Potential return on investment by rehabilitation and use of the building on the existing site; D. Efforts by owners to secure profitable new owners or lessees for the building; and E. Impact of demolition or removal on adjoining structures and the integrity of the area as a whole, including proposed new structures on the vacated site. (3) At the end of the six (6) month period, or any extension mutually agreed upon by the City and the owner, the City of North Olmsted or any other public or private body shall either make a bona -fide purchase or lease offer for the building or structure, or the application for the demolition or moving shall be recommended for approval by the Commission as provided for in Section 165.07 of this chapter. (Ord. 99-40. Passed 5-5-99.) 165.12 PROHIBITED MATERIALS. In the construction, reconstruction, restoration or other alteration of any Landmark, or other building or structure located within a Landmark District, the following materials shall not be used: (a) Neon lighting; (b) Dryvit or E.I.F.S. (Ord. 99-40. Passed 5-5-99.) 165.13 EXEMPTED BUILDING ACTIVITIES. The provisions of this chapter shall not apply to: (a) The construction or placement of swimming pools on residential property; (b) The construction or placement of fences (other than chain-link fences) on residential property; (c) The construction or placement of satellite dishes with diameters less than thirty- nine inches (except upon Landmarks); (d) Any activity which consists of or only constitutes a repair, maintenance, or identical material replacement of a component of any building or other structure.
