CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2018 - 98 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTIONS OF 1364.100 OF CHAPTER 1364 <br />OF THE INTERIOR MAINTENANCE CODE ENTITLED "NOTICE OF <br />VIOLATION" IN ORDER TO PROVIDE AN ADDITIONAL METHOD OF <br />SERVICE FOR A NOTICE OF VIOLATION, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Interior Maintenance Code provides standards for the maintenance of <br />premises, including considerations for health, safety and general welfare of property owners; and <br />WHEREAS, the Division of Building has determined that a significant expense is <br />incurred for the mailing of notices of violation via certified or registered mail; and <br />WHEREAS, Due Process can be sufficiently protected by mailing notices of violation via <br />ordinary U.S. Mail; and <br />WHEREAS, this Council desires to amend Sections of 1364.100 of the Codified <br />Ordinances in order to adopt modified service standards. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Sections 1364.106.3 (Method of service) and 1364.108.1 (Application <br />for Appeal) of Chapter 1364 of the Interior Maintenance Code, shall be amended and, as <br />amended, shall read in their entirety as set forth in Exhibit A, with such additions noted by <br />boldface and deletions noted as stricken. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is necessary that this legislation be effective immediately so that the <br />modified standards can be in effect for the purposes of reducing needless costs in the Division of <br />Building; and further provided it receives the affirmative vote of two-thirds of all members of <br />Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor. <br />PASSED: A,%uF f r 7,0. ;1O I <br />ATTEST: <br />First Reading: 04�- t q <br />Second Reading: 1/- 7-1'6 <br />Third Reading: <br />Committee: <br />
