CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2018 - 105 <br />By: Mayor Kennedy <br />AN ORDINANCE AUTHORIZING THE MAYOR TO CONTRACT <br />WITH PELTON ENVIRONMENTAL PRODUCTS COMPANY TO <br />PURCHASE A CENTRIFUGE SCROLL (ROTATING ASSEMBLY), <br />AND TO ENCUMBER FUNDS FOR A COST OF S133,500.00, FOR <br />USE AT THE WASTEWATER TREATMENT PLANT, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Wastewater Superintendent, under the direction of the Director of Public <br />Service, recommends that the City purchase a Centrifuge Scroll (CF 4000 Rotating Assembly) <br />which will provide backup support for the GEA Centrifuge at the Wastewater Treatment Plant <br />(W WTP); and <br />WHEREAS, the administration budgeted for this expenditure in 2018 and the Council <br />previously approved this expense in 2018, subject to funding being encumbered therefore; and <br />WHEREAS, it is desire of this Council to authorize the Mayor to purchase said <br />equipment through a contract with Pelton Environmental Products Company for the quoted <br />purchase price of $130,000.00, plus 3,500.00 shipping, as a sole source provider of such precise <br />equipment and the authorized U.S. representative for the GEA Centrifuge. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to purchase from Pelton <br />Environmental Products Company, a sole source provider of GEA Centrifuge equipment, one (1) <br />CF 4000 Rotating Assembly, compatible with the existing GEA Centrifuge at the W WTP, as <br />described by Scope of Supply and Pricing, with Specific Terms and Conditions, as on file for the <br />purchase price estimate of $130,000.00, plus shipping costs of 3,500.00. If necessary to <br />effectuate such purchase, the Mayor is hereby authorized to execute any contract and/or other <br />necessary documents required by Pelton Company. Any contract executed by the Mayor shall be in <br />a form and substance consistent with the provisions of this Ordinance and be approved by the <br />Director of Law. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the public health, safety and welfare and for the further reason to meet <br />deadlines for the expenditure of funds for these parts in 2018 and further provided it receives the <br />affirmative vote of two thirds of the members of Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />
