CITY OF NORTH OLMSTED ORDINANCE NO. 2018 - 115 BY: Councilmember Williamson AN ORDINANCE AMENDING AND RESTATING SECTIONS 55 7.01, 55 7.02, 557.03 AND 557.06 OF CHAPTER 557 OF THE GENERAL OFFENSES CODE OF THE CITY OF NORTH OLMSTED, ENTITLED "SALE OF CIGARETTES AND TOBACCO PRODUCTS TO MINORS," IN ORDER TO LOCALLY PROHIBIT THE SALE TO, OR POSSESSION BY, MINORS OF ELECTRONIC CIGARETTES AND VAPING DEVICES, AND DECLARING AN EMERGENCY. WHEREAS, in 2001, the City Council adopted 2001-89 locally prohibiting the possession and use of cigarettes and other tobacco products by children under the age of 18 years in the same manner as then new R.C. Section 2151.87; and WHEREAS, smokeless "vaping" devices or electronic cigarettes are a recent entrant into the marketplace and are currently being possessed and utilized by minors; and WHEREAS, it is the desire of Council to amend local legislation to include a prohibition against minors possessing and using electronic cigarettes or vaping devices and the sale of the same. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION ONE: That Section 557.01, 557.02. 557.03 and 557.06 of the General Offenses Code of the City of North Olmsted, which currently read as follows: 557.01 DEFINITIONS. (a) "Cigarettes" includes any roll for smoking made wholly or in part of tobacco, irrespective of size or shape, and whether or not such tobacco is flavored, adulterated or mixed with any other ingredient, the wrapper or cover of which is made of paper, reconstituted cigarette tobacco, homogenized cigarette tobacco, cigarette tobacco sheet or any similar materials. (b) "Tobacco products" includes the proceeds, yield or final form of anything made up wholly or in part of genus of plant known as "Nicotiana". Such products include but are not limited to cigars, pipe tobacco, chewing tobacco and snuff.
