CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2018 - 103 <br />BY: Mayor Kennedy <br />AN ORDINANCE AUTHORIZING THE MAYOR TO REQUEST <br />PROPOSALS FOR PLUMBING, HEATING, VENTILATION, AIR <br />CONDITIONING AND PLUMBING PREVENTATIVE <br />MAINTENANCE SERVICES FOR THE CITY'S DIVISION OF <br />RECREATION AND FURTHER AUTHORIZING THE MAYOR, <br />SUBJECT TO APPROVAL OF THE BOARD OF CONTROL, TO <br />ENTER INTO AN AGREEMENT WITH THE CONTRACTOR <br />SELECTED IN THE RFP PROCESS. <br />WHEREAS, the current contract for preventative maintenance services on the plumbing, <br />heating, ventilation and air conditioning ("HVAC") systems in the Division of Recreation is <br />scheduled to terminate in 2019; and <br />WHEREAS, the Mayor has requested that this Council authorize him, pursuant to the <br />provisions of Chapter 112 of the North Olmsted Codified Ordinances, to initiate a new RFP <br />process to select for a new term the most qualified corporation, firm or individual to provide <br />preventative maintenance services for the City's plumbing and HVAC systems within the <br />Division of Recreation; and <br />WHEREAS, in accordance with the recommendation of the Mayor, it is the desire of this <br />Council to so authorize the Mayor to request proposals from corporations, firms or individuals <br />qualified to provide such preventative maintenance services for the City's plumbing and HVAC <br />systems within the Division of Recreation. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to request proposals from <br />firms qualified to provide HVAC maintenance services for the Division of Recreation in <br />accordance with the Request for Proposals prepared by the Mayor. A copy of the said Request <br />for Proposals is on file in the office of the Mayor. <br />SECTION 2: That the Mayor be and he hereby is authorized, upon approval of the Board <br />of Control, to enter into an agreement or agreements with the firm selected in the RFP process. <br />Said agreement shall be in the form that is not substantially adverse to the City and which is <br />approved by the Director of Law. The character of any content not being substantially adverse to <br />the City shall be evidenced conclusively by the execution of the agreement by the Mayor and the <br />approval of the agreement by the Director of Law. <br />
