Aug. 2011 <br />TALI, OF SALE <br />(Structures) and/or <br />Miscellaneous Improvements <br />C/R/S CUY - North Olmsted - <br />Signals Phase 2 <br />PARCEL 236-09-005 (4-SH,'I') <br />PID NO 95109 <br />This Contract made and entered into this' day ofG�°Aii�f✓ _ 2018 by Higbee West MAIN, LP, it <br />Delaware limited partnership (hereinafter called "Owner") and the City of North Olmsted, Ohio (hereinafter called <br />the "LPA"), and is based on the following understanding: <br />Situated on a portion of Parcel No. 236-09-005, the following described improvement(s) (hereinafter collectively <br />referred to as the "Improvements"): <br />LIST STRUCTURESAMPROVE MENTS AND COMPENSATION FOR EACH <br />200 SF Asphalt Paving @ $3.00/SF = $600.00 <br />10 LF Concrete Curb & Gutter @ $14.75/LF (RND) = $150.00 <br />Pavement arrows and striping @ $200.00 <br />356 SF of grass/sod Ll $0.30/SF (RND) = $110.00 <br />It is mutually agreed and understood between the Owner and the ITA as follows: <br />I. The sum, $16,540.00 is the entire amount of money to be paid to Owner fol' the II1lproveInents In connection <br />with Owner's grant to the LPA of an Easement and a Temporary Construction Easement of even date herewith <br />(collectively, the "Easements"). <br />2. The Owner is to remain in possession of the Improvements for a period of time alter the execution of this <br />Agreement, which period of time is set forth in Paragraph 'three hereof. The Owner shall keep any insurance <br />policies in effect on the Improvements so long as it has possession of same. <br />3. The Owner shall remain in possession of the Improvements and shall protect and preserve or cause same to be <br />protected and preserved as they now exist and shall deliver possession of same to the LPA, it's employees or <br />assigns as directed by the LPA Projects Manager during the term of the easements referenced in Paragraph One <br />hcrcof. <br />4. It is agreed that the Improvements shall be delivered, by the Owner, intact. <br />5. The Owner, via the Easements, shall grant the LPA the right to enter onto the land described herein, where the <br />Improvements are located, and the I.YA shall remove the Improvements and replace the same to as good or <br />better condition as exists on the date hereof*, in accordance with the plans on file and shall at all tithes maintain <br />access to Owner's parcel and remove debris and construction materials frons the Improvements via the most <br />direct and practical route to the nearest public highway or street. <br />Page 1 of 2 <br />
