CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2019 - 15 <br />BY: Mayor Kennedy <br />AN ORDINANCE ACCEPTING A TRAFFIC CONTROL <br />EQUIPMENT EASEMENT LOCATED ON PROPERTY OWNED BY <br />COLUMBIA LAND DEVELOPMENT CO., AND DESIGNATED AS <br />PERMANENT PARCEL NUMBER 236-05-067 BY CUYAHOGA <br />COUNTY MAPS AND RECORDS, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, Columbia Land Development Company, an Ohio Corporation, in <br />consideration of just compensation, has offered a Permanent Easement for Right of Way <br />($14,255.00) to support Traffic Control Equipment to the City of North Olmsted, copies <br />of which are attached as Exhibit 1; and <br />WHEREAS, additional right of way in support of the traffic signalization project <br />is needed for public road improvements to be installed in the area adjacent and parallel to <br />Country Club Boulevard as part of the North Olmsted Signals Phase 2 Project; and, the <br />location of which is legally described in Exhibit A of the Easement; and <br />WHEREAS, this Council desires to obtain from said owner a temporary <br />construction and permanent easement for installation, operation and maintenance of said <br />Traffic Control Equipment Easement, as situated on a portion of Permanent Parcel <br />Number 236-05-067; and <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLSMTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor is hereby authorized to accept, on behalf of the <br />City of North Olmsted, an Easement for Permanent Right of Way, as necessary for <br />Traffic Control Equipment, from Columbia Land Development Co., an Ohio Corporation, <br />the owner of certain real property located along the south side of Country Club Boulevard <br />and known as part of Permanent Parcel Number 236-05-067. A copy of said Easement, <br />which the Mayor is authorized to accept on behalf of the City, is attached as Exhibit 1 <br />and made a part hereof as though fully rewritten herein. <br />SECTION 2: That the Engineer of the City of North Olmsted is hereby directed <br />to cause said easement to be recorded in the Office of the Cuyahoga County Fiscal <br />Officer. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, health, safety and <br />welfare of the City of North Olmsted, Ohio and for the further reason that it is necessary <br />that this Ordinance go into effect immediately in order to support the installation and <br />
