LPA RE 804 E <br />Rev. 10/2017 LPA <br />EASEMENT <br />The Columbia Land Development Co., an Ohio corporation, the Grantor(s), in consideration of <br />the sum of $14,255.00 to be paid by the City of North Olmsted, the Grantee, does convey(s) to Grantee, <br />its successors and assigns, an easement, which is more particularly described in Exhibit A attached, the <br />following described real estate (the "Property"): <br />PARCEL(S): 236-05-067 SH <br />CUY-NORTH OLMSTED-SIGNALS PHASE 2 <br />SEE EXHIBIT A ATTACHED <br />Cuyahoga County Current Tax Parcel No. 236-05-067 <br />Prior Instrument Reference: Plat Volume 208, Page 9, Plat Volume 184, Page 68 and Deed Volume <br />10367, Page 593 of Cuyahoga County Recorder's Office. <br />Grantor(s), for itself and its successors and assigns, covenant(s) with the Grantee, its successors <br />and assigns, that it is the true and lawful owner(s) in fee simple, and has the right and power to convey the <br />easement and, based on the actual knowledge of Jay L. Pierman, President of Grantor, that the Property is <br />free and clear from all liens and encumbrances, except: (a) easements, restrictions, conditions, covenants <br />and matters of record; (b) all legal highways; (c) zoning and building laws, ordinances, rules, and <br />regulations; and (d) any and all taxes and assessments not yet due and payable; and that Grantor(s) will <br />warrant and defend the property against all claims of all persons. <br />The easement conveyed is being acquired by Grantee for a public purpose, namely as reasonably <br />necessary for the replacement and future maintenance of the traffic and pedestrian signals and related <br />appurtenances and shall remain in effect so long as such purpose is necessary.
