., .? <br />- 2 - <br />the Ohio Constitution and Chapter 165 of the Ohio Revised Code, <br />and if such requirements are met, to issue revenue bonds of the <br />State pursuant to the authority of Article VIII, Section 13, of <br />the Ohio Constitution and said Chapter 165 of the Ohio Revised <br />Code, for the purpose of assisting in the financing,of the <br />acquisition, construction and equipping of the Project, to be <br />located within the boundaries of this City. This request is <br />solely for the purpose of complying with Section 165.03(C) of <br />the Ohio Revised Code, as that sub-section concerns itself with <br />the necessity of obtaining the request of the Council when the <br />State of Ohio is to be the issuer of bonds and the Project is <br />to be located within the boundaries of the municipal <br />corporation. This Council and the City do not intend by this <br />request to assume any other duties or liabflities under Chapter <br />165 ofmthe Ohio Revised Code, to serve as a guarantor of any <br />liabilities or obligations, to effect the bonding or debt <br />limitations of the City or to modify or waive the applfcation <br />of any municipal ordinance, resolution or regulation with <br />respect to the Project. <br />Section 2. That the Clerk of this Council be and she <br />is hereby authorized and dfrected to forward a certified copy <br />of this Resolution to the Ohio Development Financing <br />Commission, which certified copy of this Resolution shall be <br />the written request called for by division (C) of Section <br />165.03 of the Ohio Revised Code. <br />Section 3. That it is found and determined that all <br />formal actTons of'-this Council concerning and relating to the <br />passage of this Resolution were adopted in an open meeting of <br />this Council, and that all deliberations of this Council and of <br />any of its committees that resulted in such formal action, were <br />in meetings open to the public, in compliance with all legal <br />requirements including Section 121.22 of the Ohio Revised Code. <br />' Section 4. That in the interest of the public health, <br />safety and welfare of the inhabftants of the City of North <br />Olmsted, in order to provide for the financing of the proposed <br />facilities at the earliest poasible time, dn emergency is <br />hereby declared to exist and this Resolution shall take effect <br />and be in force from and af ter its passage and approval by the <br />Meyor.
