CITY OF NORTH OLMSTED <br />ORDIN.ANCE N0. 82 - 123 <br />BY: ? <br />AN ORDINANCE REGULATING THE OPERATION OF DRIVE-THRU <br />RESTAURANT SALES AREAS BETWEEN CERTAIN HOURS <br />WHEN THE SAME ARE LOCATED CLOSER THAN 250 (TWO <br />HUNDRED FIFTY) LINEAR FEET OF ANY RESIDENTIAL STRUCTURE. <br />WHEREAS, in the past several years many fast-food restaurants <br />have expressed a desire to not only accommodate their patrons with <br />seating arrangements in their establishments, but to also provide <br />for carry-out service whereby the customer drives up to a communi- <br />cation device and then further p.icks up an order at a window <br />without having to exit the automobile, and <br />WHEREAS, this Council has been made aware that in some instances, <br />these types of arrangements have disturbed the quiet in residential <br />neighborhoods, and <br />WHEREAS, it is the desire of this Council to regulate the use <br />of drive-thru facilities when the same are located closer than 250 <br />(two hundred fifty) feet from any residential structure. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION l: That this Council does hereby regulate the use of <br />drive-t?iru restaurant facilities by adopting the following provisions: <br />(a) No person being the owner, operator, tenant, <br />employee or agent of any restaurant shall <br />sell or offer for sale any of its products <br />through a drive-thru facility after 11:00 pm <br />Sunday through Thursday, and after 12:00 midnight <br />on Friday and Saturday, if said restaurant is <br />located within 250 (two hundred fifty) linear feet <br />of any residential structure. <br />(b) Any person violating the provision of this <br />regulation shall be guilty of a minor misdemeanor, <br />the fine of which shall not exceed $100.00 (one <br />hundred dollars). <br />SECTION 2: That this Ordinance shall take effect and be in <br />force rom an after the earliest period allowed by law. <br />PASSED : <br />ATTEST: <br />& A2 <br />FLORENCE E.
