", CITY OF NORTH OLMSTED ORDINANCE N0. 82- 17 BY: ` AN ORDINANCE GRANTING THE EXTINGUISHMENT AND RELEASE OF A WATER LINE EASEMENT GR.ANTED TO THE CITY OF NORTH OLMSTED AND THE CITY OF CLEVELAND, WHICH EASENIENT WAS HERETOFORE ACCEPTED BY SAID MUNICIPAL CORPORATIONS AND RECORDED IN VOLUME 191, PAGES 78 AND 79, OF CUYAHOGA COUNTY PLAT RECORDS, AND TO FURTHER ACCEPT A NEW EASE- N1ENT IN PLACE THEREOF, FOR THE INSTALLATION AND MAIN- TENANCE OF A WATER LINE FOR THE PURPOSE OF SUPPLYING WATER SERVICE BY THE CITY OF CLEVELAND TO LAND OWNED BY THE GREAT NORTHERN PARTNERSHIP. WHEREAS, this Council previously accepted an easement on private property for the supply,ing of water service to land owned bv Great Northern Partnership, and WHEREAS, it has been determined that the easement heretofore established, which runs parallel to Countxy Club Boulevard is no longer appropriate because of its effect on the development of said property and it is the desire of the Great Northern Partnership, together with the recommendation from the Planning Commission to have an alternate easement established for the supplying of water service to the subject private property owned by Great Northern Partnership, which is more fully set out on the plat of survey water main easements, Great Northern Corporate Center, which is dated October, 1981. NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTX OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That this Council does hereby vacate the water line easement t at is more specifically set out in Volume 191, Pages 78 and 79 of Cuyahoga County Plat Records, which is more specifically designated on the plat of survey water main easements, Great Northern Corporate Center, dated October, 1981, and designated in yellow, which plat is attached hereto and made a part hereof and marked Exhibit "A". SECTIQN 2: That this Council does hereby accept an easement from Great Noxtiexn Partnership for the installation and maintenance of a water main for the purpose of supplying water service by the City of Cleveland into the Great Northern Partnership property which is more fully set out on Exhibit "A", which is attached hereto and made a paxt hereof, and further said easement is more fully delineated on Exhib.it "A" and marked in red. SECTION 3: That the Engineering Department of the City of North Olmste is hereby directed to cause said plat of survey water main easements, Great Northern Corporate Center, to be recorded in the Office of the Cuyahoga County Recorder's Office. SECTIQN 4; That the Clerk of this Council is hereby authorized to foxward a certified copy of this Ordinance to the Director of Public Utilities of the City of Cleveland.
