. <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 82- 73 <br />PAGE 2. <br />(e) From and after September l, 1982, any person <br />desiring to develop property for general retail <br />business purposes located in a General Retail <br />Business District or a Mixed Use District, <br />reauiring more than twenty-five (25) parking <br />spaces as specified in the Zoning Code, shall <br />be required to include in their parking layout <br />plan submitted to the Building Department, <br />handicapped parking spaces, which shall be on <br />the formula of: <br />One (1) handicapped space for every twenty- <br />five (25) parking spaces. <br />Two (2) handicapped spaces for every twenty-six <br />(26) to fifty (50) parking spaces. <br />Three (3) handicapped spaces for every fifty-one <br />(51) to ninety-nine (99) parking spaces. <br />Four (4) handicapped spaces for every one hundred <br />(100) to one hundred ninety-nine (199) parking <br />spaces. <br />Five (5) handicapped spaces for every two hundred <br />(200) to two hundred ninety-nine (299) parking <br />spaces. <br />Six (6) handicapped spaces for every three hundred <br />(300) to three hundred ninety-nine (399) parking <br />spaces. <br />Seven (7) handicapped spaces for every four hundred <br />(400) to five hundred (500) parking spaces. <br />One (1) handicapped space for each additional two <br />hundred (200) spaces over five hundred (500). <br />The establishment of said handicapped spaces, as <br />provided herein, shall be a condition for the issuance <br />of an occupancy permit as provided for in the Building <br />Code. <br />(f) Any person who violates Subsection (d) hereof <br />shall be guilty of a minor misdemeanor, the fine <br />for which may not be waiverable as provided in <br />Section 351.18 of the Codified Ordinances. Any <br />person charged under Subsection (d) hereof, shall <br />have an absolute defense if they are, in fact, <br />handicapped as defined by Ohio Revised Code <br />Section 4511.69(H)." <br />SECTION 2: That this Ordinance hereby repeals Subsection (d) <br />of Secion 351.04 of the Codified Ordinances, together <br />with any other Ordinances in conflict herewith.
