CITY OF NORTH OLMSTED <br />ORDINANCE N0. 82-85 <br />PAGE 2. <br />(a) No free standing telephone structure, nor any telephone <br />structure which is attached to a building exterior, shall be installed <br />until such time as the applicant has filed the proper application for <br />a building permit, and the same has been granted. Such anplication <br />shall contain a signed document from the property owner granting the <br />applicant permission to have such a telephone structure installed. <br />(b) Prior to a permit being issued, the Building Commissioner, <br />or his designated representative, shall: <br />(1) Determine that the proposed structure does not <br />impede the flow of vehicular nor pedestrian <br />traffic; <br />(2) Determine that the proposed structure does not <br />present any hazardous situation; <br />(3) Determine that the proposed structure does not, <br />in any way, infringe upon the rights of adjacent <br />residents or pronerty owners; and <br />(4) Present the proposal to the Building, Zoning and <br />Development Committee of City Council, and obtain <br />the approval of the Committee. <br />(c) The telephone company supplying the service shall be responsible <br />for the proper maintenance of the structure and maintaining the equipment <br />in working condition. The applicant shall keep the area free of litter <br />and debris. <br />(d) For purposes of granting, or denying, the reauired permit, <br />the following guidelines shall be observed: <br />(1) Where possible, any free-standing structure shall <br />be at least five feet (51) from the side yard of <br />any lot. <br />(2) The structure's location shall provide the user with <br />easy access and safety. <br />(3) The structure shall not obstruct any existing sign. <br />(4) Illumination shall be adequate, but in no case pose <br />an inconvenience to adjacent residences or businesses. <br />(5) Adequate parking shall be provided. <br />(6) The number and location of existing outdoor telephone <br />pay stations in the general area shall be considered. <br />(e) Decisions of the Building Commissioner, his designated <br />representative and/or the Building, Zoning and Development Committee <br />may be appealed to City Countil. The majority decision of City Council <br />shall be final. <br />(f) The company installing the equipment and supplying the tele- <br />phone service shall be registered with the Building Department of the <br />City, such registration to be renewed annually.
