EXHIBIT A- ORDINANCE N0. 8?2-96 -BET4JEEN THE CITY OF NORTH OLMSTED AND THE GREAT NORTHERN PARTNERSHIP TO PROVIDE STREET ILLUP1INATION ON COUNTRY CLUB ? BOULEVARD. THIS AGREEMENT made at North Olmsted, Ohio; this day of , 1982, between the Great Northern Partnership (Great Northern of North Olmsted, Ohio and the CITY OF NORTH OLMSTED, OHIO, a Municipal Corporation (herinafter referred to as "City"). WITNESSETH: WHEREAS, Great Northern owns lands located in the City of North Olmsted on the northerly and southerly sides of Country Club Boulevard from approximately 700 feet west of the intersection of Great Northern Boulevard with Country Club Boulevard to a distance of approximately 1,600 feet west of that point; and WHEREAS, Great Northern desires to illuminate Country Club Boulevard from approximately 700 feet west of the intersection with Great Northern Boulevard to 1,600 feet west of that point; and WHEREAS, the City is desirous of improving the safety of the public through roadway illumination; and WHEREAS, the City requires that Great Northern, at Great Northern's sole cost and expense, shall install street lighting on Country Club Boulevard from approximately 700 feet west of the intersection with Great Northern Boulevard and to a distance of approximately 1,600 feet west of that point consisting of high-pressure sodium liminaires mounted on galvanized steel poles and underground wiring; development of all plans, specifications and estimates of costs to be prepared in accordance with the standards of the Cleveland Electric Illuminating Company and the City; and WHEREAS, following the installation-of said street illumination and appurtenances, the same are intended to become the property of the City, and the City shall, after twenty-four (24) months of operation become responsible for the operation, maintenance and replacement of the street illumination; and WHEREAS, the Cleveland Electric Illuminating Company shall, through agreement with the City, provide the power and maintenance. NOW, THEREFORE, for valuable consideration, the receipt and legal sufficiency of which are hereby acknowledged, the parties agree; (1) Great Northern, at Great Northern's sole cost and expense, shall have prepared plans, specifications and estimates of cost approved by the City Engineer and the Cleveland Electric Illuminating Company for the roadway illumination of Country Club Boulevard from approximately 700 feet west of the intersection with Great Northern Boulevard and to a distance of approximately 1,600 feet west of that point. (2) The plans shall include high-pressure sodium liminaires mounted on galvanized steel poles and underground wiring to provide an average of 1.5 horizontal foot-candles with a uniformity ratio of 3 to 1. (3) Great Northern, at Great Northern's sole cost and expense, and in accordance with the plans and specifications, approved by the City Engineer and the Cleveland.Electric Illuminating Company, shall cause to be installed the roadway illumination and shall assign to the City such warranties as Great Northern shall receive from manufacturers and/or contractors with respect to said roadway illumination and installation. (4) Upon completion of installation of said roadway illumination and inspection and acceptance by the City, said roadway illumination on Country Club Boulevard shall, after twenty-four (24) months of operation, be and remain the sole property of the City; and thereafter the City, at the City's sole cost and
